He has been sentenced to four and a half years in prison.

The 40-year-old, who is one of the most decorated footballers in history, had denied sexually assaulting the woman in the early hours of 31 December 2022.

His lawyer had asked for his acquittal and Alves can appeal against the sentence.

As well as handing Alves a four-and-a-half year sentence, the court ordered him to pay €150,000 (£128,500) to the victim and said he should face five years’ probation afterwards.

Prosecutors said Alves and his friend had bought champagne for three young women before luring one of them to a VIP area of the nightclub with a toilet which she had no knowledge of.

They argued that it was at this point he turned violent, forcing the woman to have sex despite her repeated requests to leave.

Alves had maintained she could have left “if she wanted to”. However, the court found that she did not consent.

In a statement, the court said there was evidence other than the victim’s testimony that proved that she had been raped.

It said Alves had “abruptly grabbed the complainant” and thrown her to the ground. He had then raped her while preventing her from moving as “the complainant said no and wanted to leave”, it added.

The woman said the rape had caused her “anguish and terror”, and one of her friends who was with her on the night described how the 23-year-old had cried “uncontrollably” after leaving the bathroom.

Alves has been held in pre-trial detention since January 2023 and has changed his testimony on a number of occasions.

He first denied knowing his accuser only to claim later that he had met her in the toilet but that nothing had happened between them.

He then changed his version of events again, saying that they had had consensual sex. “We were both enjoying ourselves,” he alleged.

The prosecution had asked for a nine-year prison sentence. In Spain, a claim of rape is investigated under the general accusation of sexual assault, and convictions can lead to prison sentences of four to 15 years.

The law was changed recently to enshrine the importance of consent under the so-called “Only Yes is Yes” principle.

Alves played more than 400 times for Barcelona, winning six league titles and three Champions Leagues across two spells with the club. He was also part of Brazil’s 2022 World Cup squad.

Susan, a bespoke shoe manufacturer, is said to have tripped and fallen on a metal bar suspected to harbour high voltage electricity, and hence, she was electrocuted.

According to a relation of Susan, they were brought to light of her ordeal through CCTV footage released to them hours after the tragedy.

Based on the clip, Susan’s brother tweeted that said she died in the premise after she was neglected by management for hours.

He tweeted, My friend called me to tell me that his sister died at Hustle and Bustle early this morning. I quickly drove to the premises and I met my friend, friends of the deceased and employees of the Hustle and Bustle at the venue.

My friend and his people have been at Hustle and Bustle since morning demanding CCTV footage so at least we can know the events that led to her demise. The most astonishing aspect of all this is the fact that the employees keep saying that the manager is the only one with access to the footage and the manager is sleeping.

My friend’s sister died on the premises and the manager is sleeping; we are still here waiting for him to wake up from his beauty sleep.

He also said the issue was not reported to the police until the family demanded for CCTV footage from the club, which was produced seven hours later.

Based on his information, Nigerians have admonished him and his family to make legal charges against the club.

Reacting to this, management of the night club has shut down after issuing a statement sympathizing with the family.

The statement read in part, “We’re closed till further notice. This is due to the loss of our esteemed client. We are deeply saddened by this situation and need time to heal from it.

“Our prayers are with the families of the lost soul; may her soul rest in peace. We sympathise with the family on this unbearable loss.”

The FCT police spokesperson, DSP Josephine Adeh, said investigation was ongoing, adding that the police would conduct an autopsy on the corpse.

She said, “The case was reported to the police. This is a case of sudden and unnatural death, which investigation is going on. We are going to carry out an autopsy to determine the cause of death. I cannot tell you the cause of the death now until the investigation and autopsy are completed.”

The body of Brian Macharia was found lying six floors from the drinking establishment where he was captured by CCTV footage while alive and enjoying himself.

Detectives privy to the ongoing investigations believe that the suspect was thrown out from the sixth floor of the building following an altercation with the workers at the popular joint located in Ruaka town.

“He must have been thrown from the sixth floor of the building by the security guards after he differed with an attendant for breaking a beer mug,” a detective, who spoke in confidence as he is not authorised to speak to the media, told K24 Digital.

In the footage, the man is seen exchanging words with an attendant in the club near what is believed to be the joint’s kitchen.

Moments later, the attendant heads towards the exit and informs one of the security guards of what is taking place inside the kitchen.

The bouncers are then captured heading towards Mr Macharia before they manhandled him as they struggle to throw him out of the joint.

Efforts by the reveller to ask the guards to stop manhandling him fell on deaf ears as they even become more violent.

In the process, they tore his shirt and threw him inside a store that belongs to the club. Other guards are also seen giving him blows.

The commotion attracted the attention of other revellers who tried to ask the guards to stop beating up the reveller but they were equally roughed up.

He is captured with blood oozing from his nose and despite looking injured, he still attempts to get into the club and he is still roughed up.

Richard Wachira, his father-in-law, said that the victim was newly married and was yet to sire a child.

Mr Wachira said that the victim had broken arms and legs with bruises on his waist and head.

“The people, who witnessed the incident, told me that my son dropped dead inside the club but how he ended up six feet from the building remains a mystery,” he said.

Information available to 3news.com indicates that the victim in the company of friends were holding a disco jam at Next Level Club, a popular entertainment centre at Walewale, in breach of the government’s directive to have all pubs and night clubs closed.

Sources say the police picked intelligence and rounded the place up at about 11:30 pm.

In an interview with 3news.com, the Municipal Police Commander, DSP Paul Peter Akabati, confirmed the incident but denied it was the police that shot the boy.

According to the Commander, he received a report about the partying on-going around midnight of Saturday and so deployed his men to go and order all to leave.

He said those outside the entertainment centre who saw the police ran away, but others started throwing stones at them.

This, according to the commander, alerted those inside the entertainment centre that the police were around.

So they came out and attempted escaping to their various homes but the young man that was shot ran and climbed a tree and so in the process of the police trying to retreat because of the stones being thrown at them, a gunshot was heard.

The police retaliated by also firing two warning shots, DSP Akabati narrated.

This, he said, calmed the tension but later heard that someone was injured.

The police rushed the victim to the Walewale Municipal Hospital and he was admitted and attended to at the emergency ward.

The commander further revealed that some ammunition penetrated through the victims bottoms which he believes is as a result of the victim climbing the tree.

DSP Akabati disclosed that health personnel will be conducting an X-Ray on him Monday, June 8 to know the level of injury.

He revealed that investigation has commenced into the matter.

The organisers of the event have been invited to assist in investigations. No arrest has, however, been made so far.

The Municipal Commander says he is not sure at the moment which bullet hit the boy until investigations are finalised.

Meanwhile, the victim has accused the police of being behind the act.

According to the 15-year-old boy, he took to his heels immediately the police arrived but was hit at his bottom.

He said he didn’t know it was a bullet until he tried to get up and felt the pain and touched his bottoms and saw the blood.

He also refuted claims by the police that he tried climbing a tree and was shot.
