A Lagos High Court in Ikeja has dismissed a suit filed by Joseph Aloba, the father of the late Nigerian singer Ilerioluwa Aloba, popularly known as Mohbad, which sought to overturn the legal advice that cleared Naira Marley, Sam Larry, and others of complicity in his son’s death.

Delivering the ruling on Wednesday, July 3, 2025, Justice Taiwo Olatokun upheld the validity of the legal advice issued by the Director of Public Prosecution (DPP), stating that it was issued under the lawful powers of the Attorney General and therefore could not be challenged in court.

“The powers of the Attorney General (through the DPP) to decide whether or not to prosecute were lawfully exercised and cannot be questioned,” Justice Olatokun ruled.

Aloba, through his counsel Wahab Shittu, had argued that the DPP’s advice was premature, as it was issued before the completion of the coroner’s inquest into Mohbad’s death. He contended that the decision denied him and the public a fair hearing, especially amid widespread calls for justice in the controversial case.

Despite the court’s decision, Aloba’s legal team has expressed its intention to appeal. “My client is ready to test the judgment on appeal,” Wahab Shittu said.

In October 2023, the Lagos State DPP cleared Azeez Fashola (aka Naira Marley), Samson Balogun (Sam Larry), Primeboy, and Opere Babatunde, citing insufficient evidence directly linking them to Mohbad’s death. However, the advice noted that they were “discharged but not acquitted.”

Mohbad died on September 12, 2023, at age 27, shortly after parting ways with his former record label, Marlian Music. His death—surrounded by allegations of assault, intimidation, and foul play—triggered national outrage, protests, and calls for an independent investigation.

The Lagos State Government subsequently initiated a coroner’s inquest, during which several individuals were arrested and questioned. At a resumed hearing in May 2025, DPP representative Ayinde Ibrahim clarified that the legal advice was based solely on the police investigation file and not dependent on the outcome of the coroner’s inquest.

A Magistrate Court in Sabo, Yaba, Lagos, has cleared popular musician Abdulazeez Fashola, known as Naira Marley, of any involvement in the death of late singer Aloba Oladimeji Ilerioluwa, popularly called Mohbad.

Also exonerated were music promoter Samson Balogun Eletu (Sam Larry), Mohbad’s former manager Opere Babatunde, and Owodunni Ibrahim, known as Primeboy.

The ruling followed legal advice from the Lagos State Directorate of Public Prosecutions (DPP), which found no evidence linking them to the singer’s death.

However, the DPP recommended the prosecution of Mohbad’s auxiliary nurse, Feyisayo Ogedengbe, and his friend, Ayobami Sadiq, for reckless and negligent acts under Section 251 (e) of the Lagos State Criminal Law, 2015. Their trial will continue at the Magistrate Court.

In his post, Lil Smart warned that if anything happened to him, Naira Marley should be held responsible. He also accused Naira Marley of bribing law enforcement officers in Lagos, engaging in credit card fraud, and robbing him of $300.

However, in a statement issued by the police on Thursday, February 6, authorities disclosed that Lil Smart admitted in writing that his accusations were false and lacked evidence.

The arrest came after a petition was filed by Naira Marley’s legal representatives, leading to an investigation by the Nigeria Police Force National Cybercrime Unit.

On January 28, 2025, officers apprehended Lil Smart at his residence in Megamound Estate, Ajah, Lagos, recovering evidence related to the case.

Since his release, the “Soapy” crooner had not granted any interview or comment, but in the video released on Sunday, he addressed some questions and clarified his stance on the matter.

The video

In the video, Naira Marley clarified that he had no hand in Mohbad’s death, as well as refuted claims of bullying him when he was alive.

The Marlian Record Label boss dismissed accusations of involvement in Mohbad’s death, calling those who accused him jobless.

He urged them to focus on their work, emphasizing that hustling can keep them out of trouble. According to him, those who mind their own business are wise.

The 32-year-old artiste added that some call others worthless, but they do not care if the person suffers.

He explained he could not harm or kill Mohbad because he had a family to care for. He said he is looking at those accusing him of killing Mohbad as Ben 10 because they will be disgraced.

Naira Marley added that with time, those behind Mohbad’s death will be revealed. He prayed against encountering the current trouble he found himself in.

He reflected on his mother’s advice for success despite challenges.

The 32-year-old mentioned that people who accused him of killing Mohbad are jealous of him and want to bring him down.

The “Soapy” crooner said he would get a new car, house and live a good life to show off in front of those who labelled him as a murderer.

He urged people not to live to impress, but to please themselves.

His words: “I asked you to hustle and try to avoid trouble. Your mates are bubbles, and they don’t have two heads. They said you’re worthless but don’t care if you suffer. Small children will give you orders and can give you a slap.

“I have a wife at home, children, mother and father. Are they going to eat clapping or sorry? Many are rebelling, and I’m looking at them like Ben 10 because they will be disgraced soon. Trouble trouble God will not allow us to see trouble. My mother said if I see trouble, Allah will fight for me and make me triumph.”

PREMIUM TIMES reported that this is not the first time Naira Marley will maintain innocence about his involvement in his ex-signee Mohbad’s death.

On 26 September 2023, the British-Nigerian singer said he had no hand in Mohbad’s death, as well as denied running his Marlian Records label as a drug cartel.

He vowed to prove his innocence and cooperate with the authorities to clear his name with sufficient evidence.

On 4 October 2023, he turned himself in to assist the Lagos State Police Command in investigations into Mohbad’s death.

The Police Public Relations Officer, Benjamin Hundeyin, confirmed that Naira Marley was in their custody on X.

Following the announcement, the police detained Naira Marley and his associate, Sam Larry, in connection to Mohbad’s death.

On 18 November 2023, Naira Marley and Sam Larry were released from custody after meeting their bail conditions.

Sam Larry, detained on 28 September 2023, spent about 50 days in custody, while Naira Marley, arrested on 3 October last year, spent about 44 days in detention.

Police spokesperson in Lagos State, Benjamin Hundeyin, confirmed their release in a statement.

On 31 October 2023, Naira Marley and his associate, Sam Larry, filed a fundamental rights suit against the police and a Lagos magistrate, Adeola Olatunbosun.

According to the report, in the suit filed before the Federal High Court in Lagos, they are seeking N20m in damages over their continued detention for their alleged involvement in the conspiracy and murder of singer Mohbad.

In the suit filed through their lawyer, Mr Olalekan Ojo, they urged the court to declare that the continued detention “at the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State since 4 October 2023, constituted a violation of their rights.

The singer, after his release from police custody, slammed Nollywood actress Iyabo Ojo’s N500 million lawsuit over defamation of character.

Naira Marley, represented by his legal counsel, Olalekan Ojo, a Senior Advocate of Nigeria, demanded a public apology from the actress for purported defamation and libel.

Mohbad

On 12 September 2023, Mohbad was confirmed dead. He died at 27 years old

The cause of his death remains unknown to date. In the quest to know the cause of his death, the police exhumed his body for autopsy.

The result of the autopsy is yet to be released.

They were also to present three responsible sureties.

It would be recalled that Naira Marley, Sam Larry and two others were, on October 6, arraigned and remanded over circumstances surrounding the death of singer, Ilerioluwa Aloba, popularly known as MohBad.

The Magistrate, Adeola Olatunbosun told the defendants to submit their passports and ordered them to report weekly to the State Criminal Investigation Department, SCID, Panti.

In her ruling, Olatunbosun said: “As part of the bail conditions, the defendants are to surrender their  passports and make weekly appearances at the State Criminal Investigation Department.”

She also warned that no one should contact her directly on the case.

“Any attempts to contact me directly would be recorded and potentially disclosed in open court proceedings” the judge cautioned.

On October 4, 2023, the Commissioner of Police sought an order from the Magistrates’ Court in Yaba to remand them for 30 days. Chief Magistrate Adeola Olatunbosun granted the police’s application but for a duration of 21 days.

It’s worth noting that the 21-day remand order granted by Chief Magistrate Olatunbosun expired on October 26, 2023, and as of now, it has not been renewed.

The letter of invitation was dated October 26 and signed by the clerk of the Committee, Yusuf Ibrahim.

Mohbad, an ex-signee of Naira Marley’s record label, died at 27 under unclear circumstances on 12 September.

Naira Marley has also been accused of bullying or ordering the harassment of the late singer, however, police have identified other suspects connected to the death of the later singer. 

He had earlier this month turned himself over to the police and was taken into custody for interrogation and other investigation activities.

PREMIUM TIMES had reported that the House resolved to wade into the singer’s death following a motion moved by Babajimi Benson (APC, Lagos). 

The Committee was mandated to ensure that the family of the late singer gets all the due entitlement from his works.

Mohbad’s royalties

According to the letter, the lawmakers said the interaction is to ensure that the family of the later singer gets what is due to them.

“The House Committees on Justice, Youth, and Legislative Compliance invite you and the legal team of MOHBAD for an interactive meeting session as regards a referral received being a resolution of the House of Representatives during their plenary session on Tuesday 26th September 2023 with respect to the circumstances surrounding the royalties and other benefits of Mohbad and to ascertain the level of your interaction with other relevant copyright organizations, such information will guide the committee on further legislative action.

“In view of the above, you are kindly invited for an interactive session with the chairman, Committee on Justice, Youth and legislative compliance scheduled as follows,” the letter reads.

According to Lagos State Police Command PRO, SP Benjamin Hundeyin, who confirmed the news, the artiste was taken in for interrogation and assisting with the investigation into the death of Mohbad.

“Azeez Fashola aka Naira Marley has been taken into custody for interrogation and other investigation activities…#justice4Mohbad #justiceforMohbad,” he wrote.

Ilerioluwa Aloba, also known as Mohbad, died on September 12 and was buried the following day, a move that sparked criticisms and questions over his death.

Following numerous calls, the police in Nigeria began investigations to unravel the circumstances surrounding the death of the 27-year-old artist. His body was exhumed and an autopsy was conducted.

The investigative body was given two weeks to conclude. While Nigerians await further action from the police, they use the hashtag #justiceformohbad and take to the streets to protest to drum home the need for justice to be served.

Meanwhile, Marley’s arrest comes after his associate Sam Larry was arrested on Thursday, September 28 amid the ongoing investigations.

Following Mohbad’s death, videos proving his harassment and maltreatment in the hands of Sam Larry surfaced on the internet, leading to suggestions of his alleged involvement in his death.

One such was a video that showed Larry storming the set of a music video, where Mohbad was filming, with several people holding clubs to disrupt the shooting.

Mohbad before his death had also written a petition to the police seeking protection from the alleged abuse he had been subjected to at the scene of the shoot.

The petition also claimed that a violent altercation occurred, which destroyed equipment worth over N8m at the scene and left the deceased, who narrowly escaped with injuries, assaulted.

Another video which went viral showed the deceased asking Nigerians to hold his former boss responsible if he ever died.

These revelations and other allegations made Sam Larry and Naira Marley prime suspects in the ongoing investigations as Nigerians continue to demand justice for the late singer.

However, the two have denied having any hand in the death of the singer. 

In a press statement, Naira Marley wrote: “Permit me to categorically state that I have no hand in the death of Ilerioluwa, either directly or indirectly. The rumours regarding the label being a drug cartel are untrue.”

“I am not a drug lord, nor do I, Marley, belong to any cult or fraternity. I’m dedicated to proving my innocence, and I’m cooperating with the authorities to clear my name with sufficient evidence.”

Naira Marley has also been accused of bullying the late singer.

Mohbad died on 12th September and was buried the following day in Ikorodu, Lagos. The singer’s death has continued to spark controversies and generate several conspiracy theories.

On Tuesday, the Marlian boss, via an official statement on his Instagram handle, addressed the allegations. It is Naira Marley’s second official statement since Mohbad died.

The British-Nigerian singer also debunked claims he runs his Marlian Records label as a drug cartel.

He wrote, “Permit me to categorically state that I have no hand in the death of Ilerioluwa, either directly or indirectly.” The rumours regarding the label being a drug cartel are untrue.

“I am not a drug lord, nor do I, Marley, belong to any cult or fraternity. I’m dedicated to proving my innocence, and I’m cooperating with the authorities to clear my name with sufficient evidence.”

Naira Marley noted that since Mohbad died, there has been a lot of onslaught on his person and reputation globally.

The singer said all stories are woven against him in respect of his former signee’s untimely death.

“I have chosen not to say anything since being distraught over his death and not to jeopardise the investigation being carried out by government officials,” he explained.

Homecoming

Naira Marley, in his statement, disclosed his intention to come back to the country as opposed to rumours suggesting that he might not.

The Marlian boss noted that he decided to prove his innocence and set the record straight.

He wrote, “I have been out of the country since 31st August 2023, and I am yet to return. In light of the police investigations, I am arranging to return to the country to assist with the research and give my version of events.

“I am fully cooperating with the police team, and I certainly have no reason to be a fugitive when I have no hand in his death,” he added.

Naira Marley said he is still in shock over the death of the deceased, whom he considered his brother.

He further expressed how traumatic it is for him to bear the reality of Mohbad’s death as it is for Nigerians.

He said, “Truly, we had our share of misunderstandings whilst working together, but the disagreement never degenerated to the extent of wishing each other death. Even at that, we are resolving issues legally before he passes”.

The culprit

The Marlian boss alleged that someone, who is the culprit, is bent on pinning Mohbad’s death on him.

He said, “I am certain that the culprit behind the death has a vendetta against me and is fueling public opinions to have me lynched for reasons known to them.”

Naira Marley noted that in due time, the circumstances surrounding Mohbad’s death would be unveiled, and the world would know the truth.

He also explained that attempting to set someone up is not novel in the music industry as other great musicians have experienced the same and come out stronger.

He said, “Mine will not be an exception as I am innocent of the accusations.”

This comes just few hours after the Commonwealth realm and by extension, the whole world was thrown into a state of mourning following news of her demise by the Royal Family.

In a statement, it was noted that she passed on in the afternoon of Thursday, September 8 surrounded by her children and grandchildren.

Her reign of 70 years and 214 days was the longest of any British monarch and the second-longest recorded of any monarch of a sovereign country.

Naira Marley has joined other sympathizers to mourn the Queen.

He shared a video of the inking process and the final result which depicted the Queen’s face and her crown in all its glory.

In an interview on Hitz FM’s Daybreak Hitz, the award-winning Nigerian singer professed his love for Ghanaian music, noting that a few of the incoming superstars have caught his attention.

He mentioned Hitmaker Season 8 winner, Lasmid, as the particular act he would want to sign, only if he is not binding under any alliance with other record labels.

Lasmid’s claim to fame is his self-produced song, Friday Night which has garnered almost 165k views on YouTube in less than two weeks, and is currently making airwaves globally.

Giving a feedback on the song, Naira Marley described it as “serious and really good”, praising that it’s worth all the hype it is getting.

The Marlian Records boss is confident a collaboration with Lasmid will shatter the industry in Ghana, Nigeria and beyond.

Additionally, he stated his readiness to feature other mainstream artistes as he is yet-to-be released songs with Darkovibes, Quamz.

Rumours were that staff of Naira Marley walk around naked in his multimillion naira luxurious house in Lagos.

Gracing the studios of Hitz FM for his first 2022 radio interview in Ghana, the Marlian boss indicated none of such has ever happened, and he cannot even fathom how such news ever made headlines.

The I’m Coming crooner also clarified that he has never influenced people not to wear pant or underwear as reported.

Additionally, Naira Marley confirmed he has heard other “funny and crazy” rumours of stealing a car in Nigeria, as well as credit cards for which he was reportedly arrested.

While he still stands trial for the the credit card fraud allegations, he has maintained his innocence.

He is, however, not surprised as he has always been the centre of controversies, and he has been nicknamed the most notorious musician in Nigeria.

Naira Marley teased he is unperturbed by that description, adding that he is “at least influencing something”.

Car theft case against Naira Marley, siblings thrown out of court http://34.58.148.58/car-theft-case-against-naira-marley-siblings-thrown-out-of-court/ Wed, 15 Jan 2020 14:39:02 +0000 https://www.adomonline.com/?p=1741139 Magistrates’ Court in the Tinubu area of Lagos Island has dismissed a car theft charge filed by police against Nigerian singer, Azeez Fashola popularly known as Naira Marley, as well as his two brothers and their cousin.

On Tuesday, January 14,  Chief Magistrate Tajudeen Elias struck out the four counts and dismissed the case after receiving a settlement agreement between the complainant, Mr Adelekan Ademola, and the four defendants.

The defendants in the case are, Marley’s two brothers – Idris Fashola (18) and Babatunde Fashola (24), and their cousin, Kunle Obere (22)

All four were all charged with conspiracy, stealing, assault, and obstructing the police from arresting Marley.

Naira Marley was absent in court, but the other defendants were present for the hearing.
