Presiding judge, Justice John Nyante Nyadu, ruled on Tuesday, July 29, that Donkor had been given ample time to secure legal representation and should have adequately briefed her lawyer prior to the hearing.

“I ordinarily would have granted the request if the accused were illiterate,” the judge remarked.
“But for someone as literate as she is, and who knew this case had been adjourned to allow her to find legal representation, it was expected that she would update her lawyer on all relevant matters.”

Donkor’s new counsel, Mr. Nutifafa Nutsukpui, appeared in court for the first time and explained that he had only been retained the previous night and had not fully reviewed the case documents. He noted that the accused submitted incomplete materials late in the day, which limited his ability to prepare adequately.

However, Deputy Attorney General, Dr. Justice Srem-Sai, opposed the request, arguing that the late engagement of counsel should not delay proceedings.

“The motion before the court does not directly concern the third accused,” Dr. Srem-Sai emphasized.
“Disclosure is an ongoing process. When counsel officially enters the case, he will have access to all disclosures relevant to his client.”

The accused—former NSB Director Kwabena Adu-Boahene, his wife Angela Adjei-Boateng, Mildred Donkor, and a fourth individual—are facing charges of embezzling GH¢49 million in public funds and allegedly using the proceeds to acquire multiple properties.

The case has been adjourned to Thursday, July 31, 2025.

During his appearance on Channel One TV, he voiced his dissatisfaction with the legal approach taken by Adu-Boahene’s team, specifically criticizing his lawyer, Samuel Atta Akyea, for permitting his client to issue a public statement before the court proceedings had officially commenced.

“It is very unfortunate, and my old classmate, lawyer Atta Akyea, did not do well. As a lawyer, I think in situations like this, you do not allow such things, because this could be one of your defenses in court. You have already allowed the ordinary people who are not lawyers to virtually dismantle your defense. I thought that he would have been advised to keep quiet until the case starts… unfortunately, he allowed his client to make such a statement.”

He expressed concerns regarding the content of Adu-Boahene’s letter, which was addressed to the National Security Coordinator and made available to the media on Wednesday, May 7.

The letter aimed to clarify the allocation of the disputed GH¢49.1 million for various operational activities, including purported payments to Members of Parliament, an opposition party, and an aide to the then President-elect.

“When you look at the statement, it is so hollow, it is not defensible, because the timelines do not work out, and also the excuses and the sort of agencies, institutions, he claimed he had financed some of the things, you may not even have evidence to back it. Most of these transactions are not covered by documents that people will sign, because of the way they’re done. So I feel sad for the young man,” he said.

The former Abuakwa South MP stated that he prefers to step back and observe how events unfold, while accusing the Attorney General of treating him unfairly.

His comment follows an Accra High Court ruling to remand Adu-Boahene in EOCO custody for seven working days to allow the Attorney General’s office time to complete witness statements.

In an interview on Asempa FM’s Ekosii Sen, he criticised the circumstances surrounding the detention.

“I won’t file any appeal. I won’t waste my energy on an appeal. Let’s see how things will go after the one week. We will know whether they have any concrete evidence to support the case they have already tried in the public.

“We are now being accused of undermining EOCO’s work, but that is not the case. Now the reset rule of law says unless someone sleeps in the cell, we cannot complete our work. The logic is bizarre,” he said.

The embattled former Director-General is accused of signing a deal with an Israeli company, ISC Holdings Limited, to purchase cyber defense software for $7 million.

He is currently facing 11 counts of offences, including stealing, money laundering, defrauding by false pretenses, and willfully causing financial loss alongside three others—his wife, Angela Adjei-Boateng, Mildred Donkor, and Advantage Solutions Limited.

Meanwhile, the case has been adjourned to May 13 for further directions.

When pressed on whether he had severed all communications with Dr. Ayine, Atta Akyea confirmed that “I believe so.”

“For now, I don’t believe I should be discussing anything with the Attorney General. And if there is anything he wants us to do outside of trial, maybe he should find a better way of doing it. I’m scared that the kind of propaganda in the public space can put any kind of spin or interpretation on any engagement. So I’m very, very careful.”

Samuel Atta Akyea has already condemned his client’s prosecution as a “travesty of justice.”

“That is a travesty of justice, playing with the liberty of the individual,” he told journalists at the court premises.

These issues typically involve the practical steps needed to implement or enforce the original judgment, such as determining costs, permissions to appeal, or other actions related to the main outcome of the case.

The Attorney General, who prayed the court on Wednesday evening to curtail Mr Adu-Boahene’s current court bail because surveillance showed the accused person attempted to interfere with potential witnesses in the criminal trial, is expected to make further disclosures at the meeting.

The trial judge is expected to make a determination on whether or not to remand Mr Adu-Boahene into prison custody or otherwise, based on the strength of the evidence Dr Ayine will disclose at the scheduled in-camera meeting.

Adu-Boahene, his wife, one other individual, and their company have been slapped with eleven charges, including stealing, money laundering, and wilfully causing financial loss to the state.

The accused persons have also been charged with using public office for profit, conspiracy to steal, and conspiracy to commit money laundering. They have all pleaded not guilty to the eleven charges.

Mr Adu-Boahene is alleged to have masterminded the crimes during his tenure as Director-General of the National Signals Bureau when he signed a fraudulent cybersecurity contract with ISC Holdings Limited, an Israeli technology firm.

“The contract document showed that Ghana Water was to pay BNC the sum of 650,000 Ghana cedis every two weeks for secure internet services from BNC, that is the Bureau of National Communications.

“However, for purposes of the payment, Kwabena Adu Buahene provided the account details of his company, BNC Communication Limited, to Ghana Water, which religiously paid for the Internet services,” he detailed.

In 2020, after the Bureau of National Communications (BNC) officially rebranded to National Signals Bureau (NSB), the Ghana Water Company requested that payments be made to the new NSB account.

However, the Attorney General at a press conference on Wednesday disclosed that Mr. Adu-Boahen continued to reroute the payments into his private company’s account after receiving them at the official bureau.

“This criminal enterprise involved the purported provision of secure Internet services to Ghana Water Company Limited by the erstwhile Bureau of National Communications, now National Signals Bureau,” Ayine stated.

These charges were contained in a writ filed at the Accra High Court on Wednesday, April 30, 2025.

The embattled former Director-General is accused of signing a deal with an Israeli company, ISC Holdings Limited, to purchase cyber defense software for $7 million.

In total, he allegedly transferred approximately GHS 49 million (around $7 million) from the NSB’s funds into his personal accounts, falsely justifying these transactions as payments for the cyber defense systems, along with his accomplices.

“Further investigations have revealed that no cybersecurity system of the description in the January 30, 2020, contract was ever received by the Bureau of National Communication, its successor agency the National Signals Bureau, or by the Government of Ghana,” portions of the court documents read.

The couple created BNC while Mr. Adu-Boahene was still the NSB boss, and the company was used for the transaction of the security system purchased from the Israeli firm ISC Holdings Limited.

While an initial payment of GHS 9.5 million (about $1.75 million) was transferred to ISC Holdings, no further payments were made to the company.

The court documents allege that Adu-Boahene, his wife, and Mildred “therefore ran an elaborate criminal enterprise using A4 (Advantage Solutions Limited) as a holding company through which the stolen funds were funneled and laundered for their own benefit.”

“If these allegations were legitimate, the National Security Coordinator should have been the one to investigate internally, identify Adu Boahene’s replacement, examine the accounts, and determine whether there was indeed misconduct. None of that happened.

“Meanwhile, the EOCO boss, who was not part of the initial process, is reportedly uneasy. He believes Raymond Archer (Deputy Executive Director of EOCO) bypassed the normal channels and fed the information directly to Dominic Ayine, who quickly acted on it, possibly without enough scrutiny,” he said.

These sentiments echo those of Mr. Adu Boahene and his wife, who, through their legal team, insisted on their innocence. The legal team, led by the learned Samuel Atta Akyea, said:

“The Attorney General has become the media persecutor of our clients, a judge in his own court while simultaneously asserting that he is still investigating the case.”

Mr. Atta Akyea stressed that Kwabena Adu Boahene, a citizen in good standing with the law, has been doing business well before he was appointed to the high office of Director of NSB.

The suit, filed at the Accra High Court on Thursday, April 24, 2025, was initiated through their counsel, former Abuakwa South MP, Samuel Atta Akyea.

According to the plaintiffs, Dr. Ayine fabricated a false narrative alleging that they had fraudulently used a corporate account to siphon State funds for personal use.

They are seeking exemplary and punitive damages for what they describe as highly offensive and defamatory statements made by the Attorney General during a press conference held on March 24, 2025.

In addition to damages, the plaintiffs are requesting a perpetual injunction to restrain Dr. Ayine from making or facilitating any further publication or broadcast of similar defamatory content.

“The international and widespread opprobrium visited on the plaintiffs by the defendant has become a continued discussion on media outlets and has affected the young children of the plaintiffs, who are ridiculed and taunted by their mates in school,” the suit states.

They are also demanding costs, including legal fees.

“In the natural and ordinary meaning, the words spewed out to the entire world, of and concerning the Plaintiffs by the Defendant, meant and were understood to mean that the plaintiffs are criminals and fraudsters who have embezzled state funds to enrich themselves. Needless to add that the Plaintiffs are involved in money laundering,” portions of the read writ.

In court on Friday, March 28, their lawyer, Samuel Atta Akyea, made a strong case for a downward review of the bail conditions, which the court eventually granted.

Speaking at a press conference on Monday, Dr. Ayine warned that the Financial Intelligence Centre (FIC) is actively monitoring all accounts belonging to Mr. Adu Boahene and his wife. He stressed that any failure by financial institutions to comply with the directive would have serious consequences.

“All banks are also warned that if we see any wire transfers or cash withdrawals from the accounts of Mr. Adu Boahene and his companies, the Bank Managers and any employees involved will be arrested,” Dr. Ayine stated.

The minister also disclosed that authorities had traced substantial amounts of money tied to suspected illicit transactions involving Advantage Solutions Limited and BNC Communications Bureau Limited.

“Investigations have established that funds, mostly proceeds of crime from Advantage Solutions Limited and BNC Communications Bureau Limited, have been suspiciously moved through the bank accounts of these companies,” he added.

Additionally, investigations revealed at least ten companies linked to Mr. Adu Boahene and his wife, all of which were allegedly controlled by Advantage Solutions.

“For the purposes of the ongoing investigations, we will not disclose the names of these companies,” Dr. Ayine noted.

He further warned the executives and employees of these companies against attempting to move any assets, saying, “If they attempt to move assets, we will track them, arrest, and prosecute them.”

A list of landed properties in Ghana and London, allegedly owned by former Director of the National Signals Bureau (NSB) Kwabena Adu Boahene, has surfaced online.

The document reveals properties located in prime areas in Accra, along with two in London, which were uncovered during investigations by the Economic and Organised Crime Office (EOCO).

These properties became public following a press conference by Attorney General and Minister of Justice, Dr. Dominic Ayine.

Dr. Ayine revealed that Mr. Adu Boahene diverted $7 million in public funds, meant for a cybersecurity infrastructure project, into his personal accounts during his tenure.

EOCO’s investigation has linked Mr. Boahene to multiple properties in Accra’s upscale Mayfair Estates and Oyarifa, with initial payments made on several of them.

The properties include:

  • No. 2 Stream Part Drive, valued at $1 million (GHS 15 million)

  • No. 6 Edith Avenue, purchased with an initial cash deposit of $500,000 as part of a deal involving five houses

  • No. 7 Edith Avenue, acquired for $200,000

Mr. Adu Boahene served as the Deputy Director-General before becoming the substantive Director between 2017 and 2025.

EOCO arrests Kwabena Adu Boahene at Airport http://34.58.148.58/eoco-arrests-kwabena-adu-boahene-at-airport/ Fri, 21 Mar 2025 10:44:18 +0000 https://www.adomonline.com/?p=2517404 The former Director General of the National Signals Bureau (NSB), Kwabena Adu Boahene, was arrested on Thursday at Kotoka International Airport (KIA) upon his arrival from London Heathrow on a British Airways flight.

Mr. Boahene was reportedly taken into custody at 8:30 a.m. in a joint operation involving investigators from the Economic and Organised Crime Office (EOCO), led by its Deputy Director Raymond Archer, and officials from the Attorney-General’s Department.

The Majority Leader and Effutu MP, Alexander Afenyo-Markin, confirmed the arrest in a Facebook post, stating that Mr. Boahene was informed that he was on EOCO’s Stop List and was wanted by authorities.

“While patiently waiting at the lounge for his bags, he was told by the immigration officers stationed at the VIP section that there was an issue with his name which needed to be rectified at the main office at Terminal 3,” Afenyo-Markin stated.

“Deputy Director of EOCO, Raymond Archer, who was personally present along with his team, then handcuffed Mr. Adu Boahene at the departures area and escorted him through the Airport Departure Hall with approximately six officers,” he added.

According to Afenyo-Markin, Mr. Boahene was placed in a white Nissan Navara pickup with registration number GN 8850-22, escorted by fully armed officers.

“Another Navara pickup and a white Toyota Corolla also escorted him. At about 9:47 p.m., he was whisked away to an unknown location,” he noted.

The NSB, an agency of the National Security Council, is responsible for providing integrated secure signal systems for national security and intelligence agencies.

This development follows a separate raid on the home of former Bank of Ghana (BoG) Governor Dr. Ernest Addison on Wednesday dawn, which has drawn widespread condemnation.

Reports indicate that about 15 soldiers, arriving in three vehicles and wielding rifles, forcefully entered Dr. Addison’s premises.

The operation was allegedly led by Richard Jakpa, Director of Special Operations, who reportedly disabled the CCTV system before demanding Dr. Addison’s assistance in locating supposed “vaults” within the house, which they then ransacked.
