Speaking on Newsfile on Saturday, December 6, Mr Bentil questioned the procedures followed in the detention of Mr Kpebu, who was taken into custody after visiting the OSP to assist in investigations into corruption allegations he had levelled against Special Prosecutor Kissi Agyebeng.

“From the information available, the OSP’s conduct in this case appears to disregard basic procedural norms. It raises serious concerns about the agency’s commitment to lawful practice,” he stated.

He further stressed the need for accountability in the operations of the OSP.

“Institutions tasked with upholding the law must themselves operate within the law. Any deviation risks undermining public trust and the very purpose of anti-corruption efforts,” Mr Bentil added.

The IMANI Africa Vice President also called for an independent review of the circumstances surrounding Kpebu’s arrest.

Speaking on Joy FM’s Midday News on Thursday, Mr. Bentil stressed that while he is aware of ongoing engagements between Mr. Kpebu and the OSP, the circumstances surrounding the matter raise serious concerns that require urgent clarification.

According to him, the OSP must remember that it is a public office created to serve citizens, not an institution meant to intimidate or suppress them.

“We make laws for ourselves. We don’t make laws to establish tools for people to oppress us. The OSP must appreciate that it is a public office and is subject to criticism. They are not above the law. Anything they do must be properly grounded in the law. I don’t think what is going on is right,” he said.

Mr Bentil argued that Mr Kpebu, based on legal grounds, could choose not to cooperate with the OSP if the office fails to demonstrate the lawful basis for its actions.

“Martin is trying to be as law-abiding as possible. It is possible that, given what is going on, he can refuse to cooperate with the OSP because he has no responsibility to do so,” he noted.

He further urged the OSP to act with restraint, pointing out that public opinion appears to be turning against the institution due to its handling of recent matters.

Mr. Bentil emphasised that the OSP operates with delegated authority from the Attorney General and does not possess unlimited prosecutorial powers.

“They don’t have plenary powers to do whatever they want, however they want. So they should clarify what they are doing and ensure it is rooted in clear legal authority.”

Background

The saga between the OSP and Martin Kpebu stems from Kpebu’s persistent public criticism of the OSP’s operations, decisions, and leadership under Special Prosecutor Kissi Agyebeng.

Kpebu has repeatedly accused the OSP of abusing its powers, unfairly targeting individuals, and failing to tackle high-level corruption effectively. He has also questioned the legality of some arrests, seizures, and prosecutions made by the office, alleging that the OSP often oversteps its mandate.

The OSP, in response, has consistently pushed back, describing many of Kpebu’s remarks as misleading and inaccurate. The office has issued several statements defending its work and rejecting his accusations.

Speaking on Joy FM’s Midday News on Thursday, December 4, regarding tensions between the Office of the Special Prosecutor (OSP) and private legal practitioner Martin Kpebu, Bentil noted that claims against public officials should be addressed through proper channels, not intimidation.

“Somebody has alleged a number of things against the OSP. Whoever has to hear those allegations must ask for proof. It must be noted that when you make allegations against a public officer, it is not a crime. If you can’t prove it, it simply means the person you made the allegations against will go free,” he stated.

He added that if Special Prosecutor Kissi Agyebeng believes he has been defamed, the appropriate recourse is civil litigation. “If they think they have been defamed, they can take you on. But it is not a crime to make an allegation, even a false one,” Bentil explained. “It is just not good enough that people rise up and make allegations, but that still does not make it criminal.”

Bentil also criticised the OSP for what he described as an unnecessarily aggressive approach toward citizens who comment on or criticise the office. “The OSP should not take umbrage and put a citizen through all kinds of stress simply because the person believes they have made allegations against them,” he cautioned.

He concluded by noting that some believe the OSP itself may not be the ideal body to investigate allegations against Mr. Agyebeng, adding, “all that being said, let’s see how this plays out.”

Speaking on JoyNews’ Newsfile, Mr. Bentil said Ghana has witnessed “a lot of activities and talk but no real progress” in addressing the menace.

“We have talked and talked. I have said all kinds of things, some taken, some not taken. Activity is not the same as progress. We are seeing a lot of activities, a lot of stimulations, a lot of talk, but no progress,” he said.

He lamented that while the government had succeeded in creating structures like the Goldboard, passing laws, and setting up institutions to buy and trade gold, it had failed to stop illegal mining.

“Despite all the mountain of talks, when this government came in, nothing or not much has been done in terms of stopping galamsey. But we have been able to establish Goldbod, pass the law, pass the L.I., set up the institutions, go onto the ground, start buying gold—and we have mobilised millions of dollars’ worth of gold, sold it, and done all kinds of things all within this space. But we have not been able to stop galamsey,” he stated.

According to Mr. Bentil, the country’s focus has shifted from ending the destruction of water bodies and farmlands to harnessing gold from illegal sources to stabilise the economy.

“We have managed to set up systems to harness galamsey gold, convert it into dollars, and stabilise the economy—but we have not been able to stop galamsey. There is a lot of talk, no action, and the action is rather in harnessing galamsey gold to establish this economy or make it better,” he said.

He added that while some might see this as beneficial, it reflects misplaced priorities and a lack of sincerity in dealing with the problem.

“I have come to the conclusion that we will not win the galamsey fight. There is no sincerity in doing that. All of us are going to pay a very heavy price for some people’s private profit.

“It is not you and I who have to stop galamsey—it is the President, his cabinet, his ministers, and the people we have given authority to go and solve it. To me, they don’t have any interest in solving it because they think not solving it has better benefit for them politically,” he argued.

Mr. Bentil urged the public to focus on tangible results rather than political statements.

“Don’t watch the talk, watch the action. All the things I saw and heard yesterday were what I expected to hear, and I have been hearing them for over ten years. As we speak, there is more galamsey now than we had yesterday. New equipment has come into this country and found itself on galamsey sites,” he said.

He further noted that while Ghana continues to profit from the sale of gold mined illegally, the core issue of stopping galamsey remains unaddressed.

“Let’s be honest with ourselves. We are doing more to mobilise the gold than to stop the mining,” he concluded.

“We’ve talked and talked. I have said all kinds of things — some taken, some not taken. But look, activity is not the same as progress. We are seeing a lot of activity, a lot of talk, but no progress. Galamsey is getting worse, so we don’t need more talk,” he said.

He pointed out that while the government has made strides in mobilising gold resources through the establishment of the Goldboard and other initiatives, the core issue of illegal mining remains unresolved.

“We’ve passed laws, created institutions, and even mobilised billions of dollars’ worth of gold, but we have not been able to stop galamsey,” he lamented.

“I’ve come to the conclusion that we will not win the galamsey fight. There is no sincerity in doing that. It is not you and I who have to solve galamsey, it is the President, his cabinet, his ministers, and the people we have given authority to.

“To me, they have no interest in solving it because they think not solving it has better political benefits for them,” he said.

He warned that Ghana will pay a heavy price for the continued destruction of its environment in the pursuit of short-term political and financial gains.

Speaking on Joy FM’s Super Morning Show on Wednesday (September 18), Mr Bentil explained that the law treats justices of the Supreme Court and the chief justice differently when it comes to appointments and removals.

He was reacting to a suit filed by the former Chief Justice challenging her removal by President John Mahama from both the office of Chief Justice and as a Justice of the Supreme Court.

Mrs Torkornoo’s challenge specifically targets the legal foundation of the removal process, asserting that the president cannot constitutionally use the procedure established for removing a chief justice under Article 146(6) to simultaneously remove her from her position as a justice of the Supreme Court.

She maintains these are separate offices requiring distinct removal procedures under the constitution.

Commenting on the development, Mr Bentil stated, “There are justices in the Supreme Court; in our law, they are appointed in a particular way. Then there is a chief justice who is one of the justices, but he or she is appointed differently and goes through vetting differently.

“In our law, the process of removing justices of the Supreme Court is different from the process of removing the chief justice,” he explained.

He said that since these differences exist, the matter should be fully tested in court. According to him, until there is a clear judicial pronouncement, no one can say the issue has been settled.

“As long as there is room, and the processes have not been exhausted for a matter that is in contention, we should use that option. What the former CJ is doing is useful for all of us,” he said.

Mr Bentil further said that the case is not just about Mrs Torkonoo but about clarifying the law for the future.

“She does have the right to bring that matter. Because until there is a judicial pronouncement on the matter, it is not final. There is a persuasive argument in law that what she is saying may be true. All of us should hold our horses and not sound as if we know how this is going to go,” he urged.

He added that the chief justice performs unique administrative duties in addition to being a judge, which makes her role distinct from other justices.

For this reason, he believes it is worth asking whether removal as chief justice should automatically end one’s position as a Supreme Court justice.

“She qualified to become a justice of the Supreme Court and passed all the requirements. When you are removed as chief justice, it does not mean that the qualification that brought you to being a justice is suddenly gone,” he said.

Mr Bentil insisted that the matter should not be reduced to public opinion but properly be left to the courts.

“These are our views. It is properly before the Supreme Court. Let them take a look at it and make a decision on this matter. Then we will all be guided going forward,” he said.

He contrasted that vision with the current state of affairs, accusing Accra-based elites of hijacking the benefits of cocoa revenue.

“People sitting in Accra who can’t tell the difference between a cocoa tree are the ones benefiting,” he said.

“It does not make sense to take the money of poor, hardworking farmers and give it to Accra-based, suit-wearing people sitting in air-conditioned offices.”

Mr. Bentil singled out COCOBOD for particular criticism, describing it as an institution that has outlived its usefulness and now serves mainly to maintain a bloated bureaucracy.

“Look at the number of people working in COCOBOD, and for these people not to be helping the farmers but essentially sapping them and sapping them dry,” he argued.

He went further to suggest that dismantling the institution could in fact benefit the country. “If we collapse COCOBOD today, Ghana’s economy will be better, and farmers will be better. They can organise themselves absolutely,” he concluded.

Responding to a comment, he argued that elections are not always necessary, noting that the UK replaces prime ministers without fresh polls.

The NPP’s decision, announced in a statement signed by General Secretary Justin Kodua Frimpong, followed a National Steering Committee meeting on August 11.

According to the statement, the decision was influenced by the “circumstances” surrounding the death of Tamale Central MP Dr Ibrahim Murtala Muhammed in the August 6 helicopter crash, stressing the need to avoid political tensions during national mourning.

The party added that the best way to honour Dr Muhammed and the other crash victims was to intensify the fight against illegal mining and ensure a peaceful, non-contentious process to fill the vacant seat.

He, therefore, backs proposed amendments to the NPP’s constitution to elect the flagbearer ahead of national executive elections.

Speaking on JoyNews’ Newsfile on Saturday, July 19, during discussions on the NPP’s National Delegates Conference, he used an evolutionary analogy to explain why a strategic change in approach would benefit the party.

“We always say that Charles Darwin said survival of the fittest,” he noted. “What he actually said is not that. What he said is that the species that survives is the one that adapts best to its environment. And all through creation, you will see that the species that survives is not the strongest, it is not the smartest — it is the one that adapts best to its environment.”

Mr Bentil explained that the NPP, like any evolving institution, must assess its environment and adapt its internal structure accordingly. Reflecting on the party’s development since the 1992 constitution, he said:
“If you take, for instance, the NPP race, they didn’t have factions. It was Adu Boahene who said it was necessary at the time, given the environment, that you build the base and raise from the base the leader.”

He pointed out that over the past 30 years, internal factions in the NPP have become deeply rooted. “There are people who are still Kufuor loyalists in the NPP,” he observed.

Mr Bentil then questioned the logic of electing grassroots party leaders before the presidential candidate:
“The people will pick their leaders and pick the flagbearer. But if you are a smart organism and you want to adapt, would you want the people to pick the leaders at the base, and then later they pick the flagbearer who should now deal with the people at the base who may or may not align with him?”

“Or would you pick the leader at the top and let the leader at the top pick his team to prosecute the agenda that will give you the ultimate? I think the latter is smarter,” he argued.

For Mr Bentil, the practical choice is clear:
“I think, given the circumstance now, you are better off picking the leader at the top and letting him influence the picking of the team. How is that controversial?”

He added that selecting party executives first can create friction and inefficiency:
“I don’t see why you will pick people at the base and then later pick the man at the top who may not be able to work with the people down.”

He cited the case of former NPP National Chairman Paul Afoko as a cautionary example:
“We saw what happened in Afoko’s time. The party became moribund. They became immobilised for more than a year because the top was not working with the base. And who says that is a sensible thing to repeat?”

Mr Bentil made it clear that while the final decision belongs to the party, from an analytical standpoint, the strategy is obvious:
“So in short, let’s leave it to them — it is their business. But in analysis, it makes every sense to me that you pick the man at the top and you let him influence the team he is going to work with to prosecute the agenda, rather than impose something on him, then he has to create a parallel system to work with.”

Mr. Bentil’s comments follow recent revelations from government spokespersons, indicating that approximately $97 million has been expended on the project so far, with a significant portion of the funds going unaccounted for.

The National Cathedral project, which was launched with much fanfare as a national place of worship, was championed by former President Nana Akufo-Addo as a “sacred obligation to God.”

Mr Bentil accused successive governments of recycling grandiose pledges without addressing core challenges.

He cited the 1D1F initiative, where over $541 million was invested in 169 enterprises, most of which now struggle.

“We create excuses for underdevelopment, then excuses for failed projects, and finally excuses for wasted funds,” he said.

The policy analyst dismissed the 24-hour economy’s proposed pilot phase, arguing it mirrors a pattern where “pilots” absorb funds but leave no tangible impact.

“They’ll access $300 million, dig a few trenches, and declare progress. By 2028, we’ll be probing where the money went,” he asserted.

Mr Bentil stressed that without fixing critical bottlenecks—water, energy, roads, and telecoms—no 24-hour economy can thrive.

He revealed that providing water to Accra-Tema alone would cost $2 billion over four years, far exceeding the policy’s $6 billion budget.

“Prioritise basics, and round-the-clock productivity will follow organically,” he urged.

The plan to establish a “24-Hour Economy Authority” drew sharp criticism.

“Ghana’s bureaucracy already consumes 80% of revenues. We don’t need new agencies; we need existing ones to work,” Mr Bentil said, referencing IMF warnings against bloated governance.

Mr Bentil’s critique aligns with Imani’s long-standing stance on Ghana’s “parallel systems”, where governments sidestep structural reforms with flashy policies.

His remarks come amid President Mahama’s pledge to formalise the informal sector through night-shift incentives, tax breaks, and enhanced security.

NDC representatives have defended the policy as “transformational”, but Mr Bentil remains sceptical, insisting, “When you process development this way, you end up with glossy magazines and empty achievements.”

“We have a situation where we have what is called catastrophic failure. Catastrophic failure is when I give you every resource you need to do something for me, which is simple enough for you to be able to do with your competencies and the resources I have given you, and you fail totally. That’s what we’ve gotten,” he said.

He said the failure of the EC indicated either an inability or a refusal to do its job.

“When you have catastrophic failure, it is either an unwillingness to do the job or incompetence to do so,” Mr Bentil said. “

“They are either unwilling to do the job or incompetent.”

Citing the EC’s handling of the Santrokofi, Akpafu, Likpe, and Lolobi (SALL) case in the Oti Region, he described the Commission’s conduct as a clear sign of institutional failure.

“For the first time in over 30 years of our democratic journey, the people of SALL went four years without parliamentary representation. Today, their seat remains empty,” he lamented, describing it as a glaring democratic setback.

He criticised the EC’s inconsistent statements during court proceedings on the Ablekuma case.

“They initially testified under oath that there were three problems that required security intervention to resolve. If those were the facts presented under oath, why have they now changed their position?” he questioned.

He argued that the current constitutional protections shielding EC officials from dismissal are part of the problem, saying “If we were in a system where they could be dismissed more easily, they would have been sacked long ago. And failure to do so would be a clear dereliction of duty by whoever had that power.”

He echoed the call by National Democratic Congress (NDC) National Chairman, Johnson Asiedu Nketia, for the EC commissioners to resign.

“I believe all three should step aside. If they refuse, I would support efforts to have them removed, perhaps for the first time in my political life.”

Bentil also criticized the OSP’s decision to declare Ofori-Atta wanted, arguing that it exceeds the constitutional limits of the office. He emphasized that declaring someone wanted for not submitting to an investigation is not constitutionally appropriate.

Ofori-Atta was declared wanted on June 2 after failing to appear before the OSP, citing medical treatment abroad. His legal team submitted medical documents indicating he is battling cancer and is due for a procedure, but the OSP deemed the explanation insufficient. Subsequently, the OSP requested INTERPOL to issue a Red Notice for his arrest.

In a Facebook post on Thursday, 8 May, Mr. Bentil explained that while external factors such as United States monetary policy are playing a role, internal policy choices—particularly those relating to gold reserves—are having a significant impact.

“The cedi is appreciating because the US government is acting in ways that are devaluing the dollar… but there is more,” he wrote.

Mr. Bentil elaborated that both the current and previous governments have contributed to building Ghana’s gold reserves, with recent sales of gold for foreign exchange helping to stabilise the local currency.

“This government has also added to the gold reserves, BUT a check of the numbers will reveal that most of what was purchased by this government has been sold for forex, which has been pushed into the system and is shoring up the cedi,” he stated.

He further acknowledged that the foundation laid by previous administrations is paying off, and both deserve recognition.

He emphasised that the gold-for-reserve policy was initiated under the former Vice President and current NPP flagbearer, Dr. Mahamudu Bawumia, and has fortunately been continued and enhanced under the current administration led by John Mahama.

“This policy of gold purchase started in the last government and was pushed by DMB, and fortunately has been continued by this government under JM… Both governments deserve praise,” he affirmed, adding that Bawumia’s passion as the originator of the idea must be acknowledged.

In closing, Mr. Bentil cautioned against politicising the strengthening of the cedi and urged collaboration across the political divide to sustain the gains.

“I pray even more that this effort will not be politicised and bastardised, but all brains and efforts from both sides… will be tapped to sustain it,” he urged.

Reiterating the need for continuity in governance, he concluded:

“No government will develop Ghana alone. It will take all governments… working in a chain or baton relay to move us forward. Let’s build… together.”

He further expressed concern about the NIB’s approach, saying, “Going there without a warrant, going there without showing your face, going there armed, is just not right.”

Mr. Bentil defended Rev. Fordjour’s right to free speech, especially in his capacity as a legislator. “Every one of us has the right to freedom of speech. You can say whatever you want to say as long as you don’t insult somebody or commit a crime. That includes voicing out suspicions.”

Citing Article 41 of Ghana’s Constitution, he argued that citizens are not only permitted but encouraged to hold public officers accountable. “As a citizen, he can also question public officers all the way to the president. Public officers owe it to the citizenry to answer candidly, honestly, and to the best of their ability using state resources.”

Mr. Bentil questioned the justification for the attempted arrest. “To the extent that Ntim Fordjour is asking questions and demanding answers, he has not committed any crime. He is a Member of Parliament and has every right to do so.”

He added, “If he has made allegations that are not true, it is the responsibility of the one claiming it’s a crime to prove so in court. He [Rev. Fordjour] does not have to cooperate in his own investigation.”

Vice President of IMANI Africa, Kofi Bentil, has expressed disagreement with the Supreme Court’s ruling on an application seeking to restrain President John Dramani Mahama from removing former Inspector General of Police (IGP) George Akuffo Dampare and other security agency heads.

A five-member panel ruled that the application for an interlocutory injunction does not prevent the President from carrying out his public and administrative duties.

The application, filed by IMANI Ghana and Security Analyst Professor Kwesi Aning, sought to bar the President from making replacements within the security services until a final ruling on the case.

However, Kofi Bentil disagreed with the court’s decision, stating, “I was impressing on the court that even though the act has happened, in our view in law, it is void or voidable. And I was trying to impress on the court to take that kind of step, to send a message to everybody.”

He further noted that the court’s decision suggests that the ruling, expected on May 7, will have a future impact rather than an immediate one.

According to him, President John Mahama’s decision to relieve Dr. George Akuffo Dampare of his duties and replace him with COP Christian Tetteh Yohuno is unacceptable, describing it as contemptuous of the highest court of the land.

Speaking on JoyFM’s Top Story, Mr. Bentil stated that the legal principle is clear that when a case is before a court, it is unlawful and contemptuous to take actions that undermine or render the court’s decision ineffective.

“When a case is before a court, it is contemptuous of the court for anybody to take an action that overreaches the court. …What it means is simply that you don’t do anything to make nonsense of a court ruling where it is imminent.

“Now, the action, therefore, of the executive is contemptuous of the highest court of this land, because for about a year now, a case has been filed before they came into office,” he said,” he said.

He explained that although the Supreme Court has heard arguments from all parties and scheduled a date for its ruling, the President has proceeded with appointing a new IGP—an act he believes directly disregards judicial authority.

“That confusion which will erupt is exactly the reason why no law abiding person, when a case is before a court and the court is about to make a ruling, would go and try to overreach the court.

“Indeed, there is a school of thought that believes that under the circumstance, there is already an injunction in place, which is why we filed to confirm that injunction so that, if there is any doubt, nobody will act based on that.

“Now being that, as it may, that they have done what they’ve done if the court ruled that indeed, the president should not remove any IGP or security head or whatever without just cause, what happens? We end up in a very, very terrible stalemate,” he said.

Mr Bentil argued that this case is not about specific individuals, such as former IGP George Akuffo Dampare or newly appointed IGP Christian Tetteh Yohonu, but rather about safeguarding the integrity of the security system.

“We did not speak for IGP Dampare, myself and Prof Anning here, we have been at this thing for years before IGP Dampare. We don’t speak for him, and we have no problem with anybody doing their job. We have no problem with IGP Yohonu. I knew IGP Yohonu many years before I even knew IGP Dampare, so it is not about the personalities, it is about the security services.

“Now this will create confusion if that ruling comes out to hold our viewpoint that upon the reading of all the laws that are applicable, a president can appoint but may not remove a ranked officer without just cause,” he stated.

Mr. Bentil stated that it is very unfortunate that the former IGP has been replaced, noting that he hopes that when the Supreme Court ruling is delivered, and if it is in their favor, the necessary corrections will be made.

Background

Imani Ghana and security expert Prof Kwesi Aning have jointly filed a suit at the Supreme Court, seeking to restrain the President from removing the Inspector-General of Police and other heads of security agencies until an ongoing case relating to the matter is decided in May 2025.

According to the plaintiffs, the security heads in question would be unfairly treated if they were removed before the Supreme Court delivers its ruling.

The development follows widespread reports that the President intends to dismiss the Inspector-General of Police and other key security officials.

In their suit, the plaintiffs prayed the court to grant an order of interlocutory injunction restraining the Defendant, including His Excellency the President of the Republic, and the respective councils of the Ghana Immigration Service, Ghana Police Service, National Fire Service, and Ghana Prisons Service, from removing, terminating, dismissing, sacking, suspending, or otherwise interfering with the positions of the Director-General of the Ghana Prisons Service, the Comptroller of the Ghana Immigration Service, the Director-General of the National Fire Service, and the Inspector-General of Police.

The injunction is sought pending the final determination of the case.

The plaintiffs further argued that the suit raises serious constitutional issues, with the balance of convenience heavily favouring the applicants.

They contended that the government would suffer no harm should the court grant the application, as the verdict is imminent.

Moreover, should the plaintiffs fail in their case, the Executive would still have the authority to remove the security heads in question.

The suit concluded by stating that the application is just, appropriate, and necessary under the circumstances, urging the court to grant the injunction to prevent any premature dismissals before the case is fully adjudicated.

“People must go into government knowing they are stewards. A steward doesn’t enter office looking to loot as if they have just won a war,” he added.

Bentil criticized the practice of successive governments exploiting legal loopholes to allocate state resources to political allies and cronies, stressing that state assets—including lands, vehicles, and buildings—should only be disposed of through due process.

He referenced Article 296 of the Constitution, which mandates clear, published guidelines for discretionary decisions, and Article 257, which vests state lands in the President. He also cited the Public Procurement Act 663, which outlines lawful asset disposal procedures.

“When it comes to state vehicles, the Chief of Staff will write a letter granting what is more or less a waiver for a car to be sold to someone. That is not lawful. The Chief of Staff does not have that authority. The same goes for state lands,” he asserted.

Bentil insisted that state properties must be auctioned to the highest bidder to ensure maximum national benefit.

He stressed that vetting is an inquisitorial exercise, designed to uncover potential issues with a nominee rather than highlight their achievements.

“The unlimited time given to the Minority Leader is justifiable because it is really the minority that does the vetting true, alright? So to that extent, I think it’s justified.

While Mr Afenyo-Markin believes the Minority Leader’s extended questioning is fair, Mr Bentil cautioned against abuse of time, describing a three-hour stretch as excessive.

He further explained that certain probing questions, even about affiliations with secret societies, are necessary because some individuals are more influenced by religious or ideological guidance than by proper policy decisions.

Mr Bentil reiterated the call for parliamentary subcommittees to take the lead in vetting ministerial nominees, given their expertise in specific areas.

He argued that subcommittees, regardless of whether they are chaired by the opposition, have a deeper understanding of sectoral issues and should be more involved in the process.

“We’ve said, and I repeat, it’s best that the parliamentary subcommittees, which have invested time in these issues, vet the nominees,” he stressed.

“People are doing things in pursuit of this gold that will affect them, their children, and their grandchildren. People don’t appreciate the kind of dangers they themselves are involved in. We should take this thing more seriously than we have done so far and deal with it,” he urged.

Mr. Bentil also criticized Ghana’s lack of attention to land restoration efforts, arguing that stopping illegal mining should not be the only focus. Instead, he called for a long-term national plan to restore polluted lands and water bodies affected by illegal mining.

“We have not taken recovery seriously enough. We are treating stopping galamsey as the main thing to do. Maybe we will not stop galamsey in the next 10 years, but we should have a national plan for the recovery of these lands,” he stated.

The analyst called for a holistic strategy involving tougher enforcement, environmental rehabilitation, and economic alternatives for those dependent on illegal mining.

Speaking at Joy FM’s Newsfile programme on Saturday, December 14, Mr Bentil highlighted that the roots of political violence in Ghana can be traced back to the time of Ghana’s late President, Dr Kwame Nkrumah.

He explained how the overthrow of Nkrumah led to the demonization and destruction of his legacy, a pattern that continued through to the era of the late Jerry John Rawlings.

Mr Bentil emphasized that this issue is not a recent phenomenon; it has become a deeply embedded part of Ghana’s political culture. “It’s in our culture, and we must understand it,” he said.

He noted that this violence is not limited to any single political party but has affected both the New Patriotic Party (NPP) and the National Democratic Congress (NDC).

According to him, even in today’s democratic era, political violence continues to persist, and this must be reversed.

He expressed his satisfaction that two prominent political figures had recently made the right statements regarding the issue. However, he pointed out that the tone and political posture of some leaders still leave much to be desired. “What we are observing politically is not something we fully agree with,” he stated.

To effectively combat this menace, Mr Bentil called on law enforcement agencies to take stronger action against perpetrators of electoral violence.

He argued that, due to the cultural nature of the problem, it is necessary to take decisive steps to break this cycle. He further stressed that political parties must offer their full support to efforts aimed at curbing electoral violence.

“These are basic crimes,” he said, urging that they should be addressed in a manner that sets an example for society. “If we do not make a determined effort to tackle this issue, we will never be able to break this culture,” he warned.

Reflecting on the broader political landscape, Mr Bentil lamented that many politicians come to power for brief eight-year terms, only to serve their own interests.

“We, the citizens, are left to fend for ourselves in the aftermath,” he said, expressing his dismay at the current state of affairs.

“The faults, the errors, the mistakes are properly in the lapses of the EC. It is important we get this right so we can avoid some of these issues in future” Mr Bentil stated.

Mr Bentil also expressed concerns about collation activities taking place outside some constituencies, describing it as contrary to the intent of the existing electoral laws. While acknowledging that in rare cases, alternative venues, such as military barracks, might be necessary, he stressed that final collation must be returned to the constituencies.

“My view is that if it becomes necessary to do collation elsewhere, take it back to the constituencies and finish it there,” he said.

He further urged the EC to adopt a more inclusive and transparent approach, emphasizing the importance of dialogue and negotiation to resolve disputes during collation.

“When the EC shuts the door, they have a right to do so, but when you have an EC that takes the view that any time there’s a problem, the solution is to go to court, we wouldn’t be having these problems now,” he said.

Mr Bentil proposed reforms to rebuild trust in the EC, including the introduction of open recruitment processes for key positions.

“For over 30 plus years, the EC has conducted our elections, and we all know what has been said after each one. It’s time to reform our EC properly. That job should be advertised, interviews conducted, and the right person picked for the role,” he stated.

He concluded by stressing the need for systemic changes to prevent further issues, calling on the EC to take responsibility for ensuring credible and trusted elections in Ghana.

According to him, the Supreme Court has clearly demonstrated its approach to constitutional interpretation through detailed analyses of past cases.

He made these remarks on Joy FM’s Super Morning Show on Friday, November 15.

Mr. Bentil explained that “I have heard many people say this was very clear, everybody understands what it says, and so there is no doubt about it and it shouldn’t have even gone to the Supreme Court.”

“That is totally debunked, it is debunked even on the fact before it went to court that certain people disagreed. The fact that you have a view, and I have a different view, showed clearly that there needed to be somebody to break that jam.”

According to Kofi Bentil, the Supreme Court was properly invoked because there was a disagreement.

He further refuted the argument that the case should be taken to the High Court instead of taking the issue up to the level of the apex court.

“There was a point that it should go straight to the High Court, and if the High Court felt there was a problem with interpretation, then they refer it to the Supreme Court. The Supreme Court deals with the interpretation, then it’s referred back to the High Court to finish the matter,” he stated.

He argued that the Supreme Court can assert jurisdiction and deal with cases of interpretation issues.

Referencing the Supreme Court’s ruling, Kofi Bentil cited Page 33, which, according to him, emphasized an earlier point he made at the beginning of the interview.

“When, in one case, you have matters of interpretation, and then other matters which are specifically given to a High Court, the Supreme Court must necessarily take it. We don’t want a situation where it goes there and comes back, and goes there again, wasting everybody’s time and going back and forth.” He explained.

He went on to reaffirm the Supreme Court’s assumption of jurisdiction on the matter. According to him, the case could have gone to the High Court if there was no interpretation issue. With the Supreme Court being the highest court of the land, he asserted that it is important for it to assume its jurisdiction.

In response to Justice Tanko Amadu’s conviction that the jurisdiction of the High Court has been usurped, via a text during the show:

“Well, clearly, the majority disagree with him,” he rebutted.

Kofi Bentil continued by citing Page 12 of the court’s ruling and reiterated that it is not novel, as stated in the ruling.

He recounted a situation where Parliament was in chaos, and there was a clear interpretation of the Constitution.

“And so, for the Supreme Court to assume it, with all due respect, was the sensible thing to do, and that is what they did,” he concluded.

In an interview on JoyNews’ Newsfile on November 2, Bentil expressed concern that the Bawku conflict could spill over into other regions, given existing alliances between factions involved in the dispute.

He referenced past ethnic clashes, such as those in Agbogbloshie, as examples of how these tensions could escalate.

“It is sad and unfortunate—we are playing with fire. I am aware that during times of conflict in Agbogbloshie, we witnessed factions forming across parts of Accra. God forbid, but if violence erupts, you’ll be surprised how quickly it could spread. We’re also hearing reports of guns being supplied from Accra, so there’s much happening beneath the surface,” he cautioned.

Bentil proposed that the government enforce strict regulations on chieftaincy institutions within conflict zones, even suggesting the suspension of chieftaincy roles until disputes are resolved. While he acknowledged the cultural importance of chiefs, he emphasized that public safety must take precedence, noting that chiefs, while respected, are not indispensable to the functioning of the state.

He urged the government to assert its authority in Bawku by deploying the army to manage the conflict, suggesting that a state of emergency might be necessary to prevent further loss of life.

“If a state of emergency will prevent the deaths of 19 people, then implement it. This is the purpose of the state. You can’t convince me that the Ghana Army is not capable of securing Bawku—this is why we have an army, so it should enforce order,” Bentil argued.

The Minister for Local Government and Rural Development, Martin Adjei Mensah Korsah, withdrew the LI on be half of the transport minister, citing public and stakeholder concerns. He added that the withdrawal was necessary after extensive engagement with leadership.

Speaking on JoyNews’ Newsfile, Mr Kofi Bentil said“LI 21, 18 in particular had been abused, and we had to fight. Do you remember when the toll levy was passed, in the same LI? I had to get up. IMANI, we had to get up and fight for it to be repelled; otherwise, we would all be paying taxes now to a private person. So, I am happy it has been repelled, but it tells us something: the process of lawmaking and leadership does not only require MPs but all of us to be vigilant. And people were aware that people put that in and those people who put those in, mark them and vote them out”.

Mr Bentil said it does not matter if the MPs apologize, they should be marked and removed from office.

He emphasised that it is important because someone had the mindset to propose this measure.

Mr Bentil noted that instead of solving the problem for the public’s collective good, parliamentarians sought to excuse themselves using state funds.

“You want to drive above the speed limit. You want to use a siren. Let me tell you why it matters. If this law had passed, some people would have died because some reckless MP would be driving over the speed limit, using a siren, and would kill somebody, and they would say it was within the law”.

According to him, even though he supports Dr Bawumia, he said his victory must be achieved legitimately.

“Everybody knows where I stand but if Dr Bawumia is going to win this election, let him win it fair and square,” he said.

His comments come after President Akufo-Addo appointed Commissioner of Police, Christian Tetteh Yohuno as the new Deputy Inspector-General of Police in charge of Operations.

Since this news broke, a section of Ghanaians have questioned the motive suggesting that it could be an alternative means to “clip the wings” of IGP Dr George Dampare or remove him.

Speaking on Joy FM’s Newsfile Mr Bentil stated that the President made an error in appointing a deputy IGP with a designated task, arguing that it lends credence to the allegations in the leaked audio suggesting a plot to oust Dr Dampare for his uncompromising stance against rigging the upcoming election.

“The NPP as a group absolved itself sufficiently when they voted together with the minority to accept the Commission’s report in Parliament and that showed that the NPP didn’t have a problem and did not have a problem with IGP Dampare and not seeking to remove him,” he said on Saturday.

Despite this, Mr Bentil expressed concern over actions by certain government operatives that he believes undermine this commitment.

“Now you clearly have a situation where operatives within this same government have gone to do something which is clearly not permitted within the law so it brings back that situation.”

“… We’re not stupid, people see what is going on and it doesn’t help anybody,” he told Samson Lardy Anyenini.

He warned that the actions of these operatives could hurt public perception.

“When you have a situation that the nation is moving in a certain direction what will change minds is talking. Dr Bawumia is campaigning so those operatives who think that this is a way to win the election are wrong and they should stop it!”

He asserted that Nkrumah’s tenure saw fewer accomplishments compared to President Akufo-Addo’s.

Although Dr Prempeh has since apologized for his comments, Kofi Bentil argues that these remarks were an unnecessary mistake and politically incorrect, potentially giving an advantage to his opponents.

“That was an unforced error. It was an unnecessary mistake. It was the mistake of Napo coming to fall and this is what people have been talking about. It was bad period, it was a negative.” he added.

According to Mr Bentil, these delays are primarily caused by political calculations rather than any other factors.

He expressed his belief that the apex court has the potential to perform much better than it currently does and urged the court to improve its efficiency and effectiveness.

Mr Bentil emphasised that addressing these delays is crucial for the credibility and functioning of the judicial system.

In an interview on JoyNews’ Newsfile programme on Saturday, July 6, Mr Bentil reiterated his point about the need for the Supreme Court to enhance its performance.

He was commenting following a letter dated May 30, 2024, from the Chief Justice to the President, requesting the nomination of five new judges to the Supreme Court.

Among the recommended judges was Justice Afia Serwaa Asare Botwe, currently presiding over the ambulance procurement trial involving NDC MP and Minority Leader Dr Cassiel Ato Forson.

The other nominees were Justice Cyra Pamela Koranteng, Justice Edward Amoako Asante, Justice Eric Kyei Baffour, and Justice Angelina Mensah Homiah.

Despite his criticisms, Mr Bentil also noted that the country could benefit from a larger Supreme Court to handle its caseload more effectively.

“It is utterly distasteful when politicians are involved in the judiciary. It is utterly disgusting which is part of political calculation. I believe the Supreme Court can do far better than it is currently doing. So I insist the Supreme Court delays are caused by political calculation, not inefficiencies.”

The National Democratic Congress (NDC) on Thursday, July 4, accused President Akufo-Addo and the Chief Justice of colluding to shield current government officials from accountability once their term ends.

The opposition party alleged that the Judicial Council had unanimously resisted efforts to elevate five judges to the Supreme Court, but these efforts were covertly overridden by the Chief Justice and the President.

Fifi Kwetey, the NDC’s General Secretary, expressed concern over the move, describing it as unjust and calling for it to be contested.

The Attorney General Godfred Yeboah Dame has dismissed the NDC’s assertions, defending the integrity of the nomination process.

The Chief Justice has also justified her recommendation to President Akufo-Addo, insisting that the Supreme Court needs more judges to handle the overwhelming number of cases currently before it.

It is about whether in the calculation to achieve his goal, I think he hit it spot on. Everybody can talk, and have you ever come across a choice like this and people didn’t have anything to say about.”

“So everybody can talk, and the irony is that the people who are campaigning against are the ones trying to advise him. As in, they are saying, this man is not good for you. So you should have picked the other person. If you pick this man, then are going to lose. So pick the other person so you can win against us,” he stated.

Mr Bentil dismissed the notion that Dr Opoku Prempeh is arrogant, stating that he is simply assertive about his opinions and should not be labeled as such.

According to Mr Bentil, Ghanaians’ perception of arrogance differs from its dictionary definition.

“Then, you have what is being said everywhere that Napo is arrogant. I think that is not so much a negative. If you have a person like Napo who has been in the limelight and in the politics of Bantama and NPP being at the forefront for decades, being in some of the most controversial ministries and when he is elevated to the highest political position he has ever occupied, all people can say is that he is arrogant. In Ghana, arrogant is a term of art. It does not mean what it means in the dictionary. In Ghana, arrogant also mean too known,” he added.

This follows the statement by the Chairman of the special committee formed to investigate the plot to oust the IGP, Samuel Atta Akyea, explaining that the committee could not have completed its report without delving into the allegations of extrajudicial killings made against the IGP, Dr George Akuffo Dampare.

He mentioned that it was for this purpose—issues of national security—that an in-camera hearing was conducted, hence his refusal to append his signature to the special committee’s report.

In an interview on JoyFM’s Newsnight on Thursday, July 4, Mr Bentil stated that the extrajudicial killing allegation cited by the Chairman of the special committee is baseless and does not belong in such an arrangement.

“If there has been an extra-judicial killing, is this the kind of committee that is supposed to be dealing with it?

“You are talking about murder, criminal conduct of the highest level involving international dimensions. This is not the way to handle it,” Mr Bentil emphasised.

He argued that the Chairman’s intention to make the IGP the accused would not work.

The IGP’s legal representative stressed that it is impossible for Parliament to investigate the murder, especially when it involves high officials of the State and has an international dimension.

“There can be no stretch of interpretation which brings the Speaker’s remit to the point where Parliament is given the power to set up a sub-committee to investigate the murder of an international dimension involving high officials of State. It is not possible. Parliament cannot investigate murder,” he insisted.

Touching on the Speaker’s order to the committee to go back and work on the report, Kofi Bentil said that although the Speaker had the right to make such an order, he was surprised that the report had to be returned.

“I am not sure what really has to be done,” he added.

He noted that, according to the rules of Parliament, Mr Atta Akyea’s refusal to participate in the report does not affect the report.

“My worry is what else they are looking for and whether this is all just about Atta Akyea’s refusal to participate?” he questioned.

He reiterated that the Chairman appears to have a “predetermined outcome he is looking for and to the extent that he is not getting it, he is just doing everything possible to get it.”

He also expressed concern that the second order to complete the work of the committee would not open a floodgate of allegations that the committee is not required to address.

He noted that the issue was “essentially gossip and slander” and that the Police Service has its own processes for dealing with such matters, but it was blown out of proportion.

However, he criticized the Committee Chair, Samuel Atta Akyea, for running proceedings “as if he was a law unto himself.”

He said although the Speaker of Parliament gave a specific mandate to the Committee members, the Akim Abuakwa South MP, did things to suit himself.

“The specific simple matter does not take rocket science to determine, and the Speaker said we should at least do our official job about this because of the important people involved; so do AB and C… Atta Akyea actually just proceeded to hold a court, a full court trial, and then proceed to invite every and all persons to make all manner of allegations,” Bentil said on JoyNews’ PM Express.

According to Bentil, “there was no fact to be established, which required the invitation of every and all persons to make all manner of spurious founded and unfounded allegations.”

“The point I’m making is, when a committee is set up by the Speaker with a clear mandate to make groundnut soup, you cannot expand the remit to include making any other soup,” he argued.

The committee has experienced significant internal conflict following the submission of its report to Parliament, which was not signed by the Chairman. All other seven members of the committee did sign the report.

JoyNews has learned that Samuel Atta Akyea disagrees with the findings and conclusions of the other members and had wanted the committee to invite more witnesses after allegations were made against the IGP, including claims that he supervised extra-judicial killings.

But the IGP has denied these allegations.

Participating in a panel discussion on the Africa Leadership Initiative West Africa (ALIWA) on Thursday, January 25, Mr Bentil emphasized the need for a thorough examination of the spillage incident to prevent similar occurrences in the future.

According to Bentil, the Akosombo dam spillage cannot be dismissed lightly, considering the evident catastrophic failure that led to flooding, displacing thousands of people.

He pointed out that both the Meteorological Service and the Volta River Authority (VRA) had warning systems in place, raising questions about why the incident occurred despite these precautions.

“The dam does not fail overnight, it fails over many days, the Meteo service was working, and they gave the warnings, VRA itself has better systems than the Meteo systems, by which it can check. So if a dam fails over many days and there are significant warning systems, and there are multiple institutions, and it’s a Volta River Authority and in law, that [Authority] means a lot.”

“We need to ask questions as to why this happened and get to the bottom of why it happened because if the best of our best has failed then what is going on with the rest?” he questioned.

Highlighting the urgency of the situation, Mr Bentil urged Parliament to conduct a thorough probe into the spillage.

He emphasized that the flooding was not a natural disaster but a result of deliberate actions, where someone initiated the release of water, despite the awareness of people downstream, hence calling for an enquiry to unravel what happened.

“This flooding was not natural, somebody pressed the bottom, and opened floodgates, knowing there were people downstream and flooded the place. Yes, you are saying [it was done] to save the dam but how did we get to that point, if the dam broke there would be worse problems, but should we ever get to that point where we have to choose between saving a dam and risking human lives? We need to ask questions and I think Parliament should get into this.”

The discussion was on the theme “Building Resilience: A Socio-Economic Response to Natural Disasters.”

According to him, calling for the dissolution of the OSP which has been in existence only since 2018 is rather premature.

He was reacting to the Speaker of Parliament, Alban Bagbin’s remark that the creation of the OSP was an act in futility.

According to Mr. Bagbin, rather than creating the OSP, the government should have decoupled the Attorney-General’s Department from the Ministry of Justice.

He stressed that the office, under this circumstance, will not achieve any results in the fight against corruption.

But Kofi Bentil has said Ghanaians are fond of wanting quick solutions to systematic problems.

“I have to also say one of the problems I think in Ghana over these decades of public policy advocacy is that we tend to want very quick solutions. How old is the office of the Special Prosecutor? What has been the experience so far?

“We have had Mr. Martin Amidu who came in, all of us were elated, I can tell you honestly that some of us were told that Mr. Martin Amidu may not be able to achieve much. And these are people who were close to him.

“We didn’t listen, we thought look he was the greatest, we hailed him and what happened, happened. We now have lawyer Kissi Agyebeng there, how long has he been in office? How long have we resourced him? But already I can tell you lawyer Kissi Agyebeng the OSP is doing things that were unthinkable,” he said.

According to him, while the current OSP has not been in office long enough, what he has managed to achieve in this short period has been overwhelming.

“In all our experience as an independent country, some of the things that had happened in this short time were not things that we could have contemplated being done by a sitting Attorney General. So look, it is too early to cancel that office and call it a failure.

“We want results but some things happen over time and if you ask me I think we’re on the path. What we need to have is patience and continue to work at it to make sure that this thing works,” he said.

Speaking on JoyNews’ Newsfile on Saturday, he stated that public servants must understand that they lose some amount of their right to privacy after assuming their high offices.

“Please, if you go into public office, declare. The declaration must be a proper declaration, there must be transparency to it. It must be made public and everybody must know. If you don’t want that don’t go into public office,” he said.

He noted that the delay in the passage of relevant laws to ensure that government appointees and politicians are compelled to declare their assets proves just how far reaching corruption is in the country.

Mr. Bentil praised pressure group Occupy Ghana for constantly putting pressure on the government to pass the Conduct of Public officers bill into a law.

He assured that IMANI-Africa would also join the cause and go any length to ensure that the bill is passed into law.

Mr Bentil said the upcoming election has provided a perfect opportunity for IMANI – Africa to raise this issue before the politicians since they would be campaigning against corruption.

According to him, there should be a complete prohibition to prevent illegal miners from destroying the forest reserves.

“There is nothing called responsible mining in a forest reserve, those words must never be put together,” he said on JoyNews’ Newsfile on Saturday.

Mr Bentil rejected the concept of ‘responsible mining’ within forest reserves, asserting that such laws are crafted to facilitate the exploitation of these natural areas.

He underscored the distinction between a forest and a mine, emphasising that a forest reserve should retain its status as a forest, impervious to mining activities.

“They shouldn’t amend that law, they should delete it. It is there to facilitate things like mining in Kakum National Park and if we leave it there, one day we will wake up and Kakum has been mined,” he stressed.

The IMANI-Africa Vice President vehemently expressed that amending the law is insufficient; rather, it should be entirely expunged.

He argued that responsible mining is an impractical notion within the context of forest reserves, urging the government to take decisive action.

Mr Bentil went on to emphasise that the preservation of these reserves is paramount, warning that failure to delete the law could result in irreparable damage to the country’s environmental heritage.

In his view, the pursuit of profit through mining should not come at the expense of the well-being of the populace and the integrity of the nation’s ecological treasures.

According to Mr Bentil, the right to protest is a fundamental citizen’s right, and it is not anyone’s prerogative to determine where citizens can or cannot protest, as long as it is a public space.

His remarks come in response to the arrest of 49 protestors by the Ghana Police Service on Thursday, September 21, who claimed to have served an injunction application to the organizers of the #OccupyJulorBiHouse demonstration, Democracy Hub, before embarking on their protest.

The police accused the protestors of unlawful assembly and violating the Public Order Act, contending that they had disregarded court documents instructing Democracy Hub to desist from proceeding with the planned demonstration.

However, Mr Bentil suggested an alternative approach, explaining, “If you think it’s a security zone and the person says I’m going to demonstrate there and it’s a public space, then you go and put your men there; let them sit there so that both of you will occupy that space.”

The IMANI-Africa Vice President emphasised that the police should allow citizens to exercise their right to protest without committing a crime, adding, “There should be no public space that is out of bounds to a citizen who owns that space.”

He argued that individuals, particularly the police, should not just think that they have the right to give the citizens a place to press home their demands and the right not to give them.

“These are God-given rights; nobody is a Ghanaian more than anybody else, and the rights of the citizens are above the right of an office holder including the President and including the IGP,” he stressed.

Mr Bentil maintained that even if the Jubilee House is a security zone, it is a public space, adding, “If I’m disturbing your house, you can take action against me, but if it is a public space, you can’t tell me it’s a security zone.”

According to him, as long as citizens do not commit a crime, the police should not impede their right to demonstrate in public spaces.

“That right to protest in the public space is a fundamental human right, and nobody should take it away,” Mr Bentil said.

According to him, the EC is constitutionally obligated to expand and execute specific programs and has the necessary resources to do so.

Mr. Bentil explained that, any deviation from this constitutional mandate could lead to the removal of the Electoral Commissioners from their positions.

Speaking on JoyNews’ Newsfile on Saturday, Mr Bentil clarified that the issue is not merely about neglecting responsibilities; but it’s also about actively obstructing people’s right to register.

“In omission and commission, it’s not a matter of just omitting, like they are not doing anything, the suggestion is that there will be problems with people exercising their rights to register.”

According to him, the primary purpose of the EC is to address obstacles and facilitate the voter registration process, therefore, they should proactively implement measures to enhance the voter registration exercise.

“The EC was set up to take away those problems, clear the way and create situations that will enable people to register. So they should actually do things, commit actions that will expand registration,” he said.

Mr Bentil maintained that “in this case, if you are not doing it at all, then you are omitting to do your job but as far as I’m concerned, they are actually taking steps, committing actions to stop people from registering which is directly against what they are to do.”

He criticised the utilisation of state resources to undermine public policy objectives, saying “We should all be minded when we do some of these things.”

The IMANI-Africa Vice President’s assertion comes after the EC announced that the voter registration exercise would only take place at its district offices across the country.

However, this decision has not received the support of many political parties.

The National Democratic Congress and four other political parties on Thursday, September 7 sued the EC over its insistence on conducting the 2023 limited voter registration exercise at its district offices.

The suit was joined by the Convention People’s Party, All People’s Congress, Liberal Party of Ghana and the Great Consolidated Popular Party who said the decision would disenfranchise many eligible voters. 

They, thus ask the Supreme Court to prevent the electoral management body from proceeding with the exercise pending the final determination of the substantive matter.

In a Facebook post, he commended Mr Kyerematen for bowing out gracefully and with dignity.

“When the time comes to bow out, do it gracefully, with the dignity you possess. May your actions place you in good light for the future, and not damage your legacy,” he wrote.

Mr. Kyerematen announced his exit from the governing party’s flagbearer race in a statement dated September 5, 2023.

According to him, the NPP’s Super Delegates Congress seemed to be biased in favor of one candidate.

He pointed out instances of intimidation against his agents during the election process.

“In light of the foregoing, I wish to confirm that I am honorably withdrawing from the process that will lead to the presidential primaries to be held on the 4th of November 2023. In the next upcoming weeks, I will provide an indication of the role that I will play in politics in Ghana, after consultations with my family and other well-wishers, various stakeholders, and interest groups,” he stated.

His actions have been met with varied reactions on social media.

Currently four candidates including Vice President, Dr. Mahamudu Bawumia, Assin Central Member of Parliament (MP), Kennedy Agyapong, former Agriculture Minister, Dr. Owusu Afriyie Akoto, and former Mampong MP, Francis Addai-Nimoh will battle it out in the contest on November 4.

The balloting is scheduled for September 6 for the final race.

Commenting on the victory of the National Democratic Congress (NDC) in the Assin North bye-election he said “In a sound democracy, the opposition is able to win bye-elections. Well done NDC! #ProudToBeGhanaian. Now can somebody stop that shameful prosecution, it never should have started?!!”

NDC’s James Gyakye Quayson emerged winner with 57.56% of votes, with Charles Opoku of the New Patriotic Party (NPP) coming second with 42.15% and the Liberal Party of Ghana’s Enyonam Bernice Sefenu making only 0.29%.

The Supreme Court initially nullified Mr Quayson’s election as the MP for Assin North over holding Canadian citizenship and being a Ghanaian at the time he filed his nomination to contest the election in 2020.

He now faces charges of perjury and deceiving a public officer.

Upon a bye-election conducted by the Electoral Commission, the people of Assin North Constituency re-elected him to represent them in Parliament.

Mr Bentil said inasmuch as the comments are condemnable, criminal summons cannot be proffered against them. 

According to him, it will be a tedious task for the police to prove their case in court. 

Contributing to the JoyNews’ Newsfile programme on Saturday, April 15, Mr Bentil however urged the MP and other politicians to be cautious of such comments. 

“I have listened to what he said and honestly there is a portion of it that you can take with a pinch of salt as a political speech made in the heat of a moment after a political rally on a political platform. 

“Yes, I have condemned it and we must all condemn it but the question is does it rise to the level of a criminal offence for which he must be arrested, investigated and prosecuted and jailed? No, it cannot be proven,” he said. 

Abetifi MP Bryan Acheampong has said that the current New Patriotic Party (NPP) will not hand over power to the National Democratic Congress (NDC).

According to him, the party will use whatever means necessary to remain in power in the 2024 general election.

He added that if the NDC dares to use threats, and brute force in the 2024 election, the NPP will show them that they have the men.

According to him, the NDC will collapse and the NPP we will show them that “we have the men”.

Mr Acheampong said this will never happen and that the NPP will stand on a platform to hand over power to the NDC.

Following his comments, the NDC through its legal team has petitioned also the CID to immediately arrest and prosecute him. 

Per the petition, the NDC called for the arrest and prosecution of the Minister for Food and Agriculture over what they described as “reckless, dangerous, instigation and unparliamentary comments.”

The lawyer, who was speaking on the issue of disparity between Article 71 officeholders and Single-Spine workers, said the country has failed when it comes to “dealing with public sector wages over time”.

Speaking on JoyNews’ Newsfile, he said none of the problems caused can be attributed to public sector workers.

“Zero of the problems are with the public and civil servants. All the problems are with the leaders. When you employ somebody, the person’s wage is not a net loss to you because the person helps you to make more money than you pay them.

“So if you take the civil and public servants, the government workers, whatever we’re paying them, if they were producing well enough, it will not be a net loss to you, it won’t be a problem, it will be a fraction of what they’re making,” he said.

Mr Bentil argued that politicians and government officials are “messing up” the public sector.

He said proof of the above was the fact that workers from the public sector work efficiently when they are in the private sector than they do in the public sector.

“The public sector has about three times more qualifications than the private sector. And whenever they move, whether to international organizations or into the private sector, they produce massively. So why don’t they get the same levels of productivity when they’re in the civil and public service?

“It’s because of the leadership and the political messing up of that space. It’s because people are appointing political misfits into office. It is simply because the leadership there is poor at every level.”

He reiterated that the country should not blame the public sector workers for low productivity.

Public sector workers have been raising concerns over the huge gap between the salaries of Article 71 officeholders and Single-Spine workers.

By 2016, the difference between average salary earners of these two groups amounted to ₵17,088 with single spine workers taking as low as 1,128 as against Article 71 holder’s 18,211.

In view of this, organized labour recently rejected a proposal of 18% salary increment.

The group which consists of unions such as; GNAT, CLOGSAG and TUC stated that they will not accept any increment less than 60% although they are demanding a 65% increment.

“I am very happy that at least, for the first time in the short life of the Office of the Special Prosecutor we are seeing some real action. That is what we were hoping for. We hope that this will continue,” said Kofi Bentil.

According to him, he believes that the OSP will persist in the fight against corruption.

“I am hopeful that it will not be a nine-day wonder, I want to believe that he will maintain the momentum because there is a lot of work for him to do.”

Speaking in an interview on PM Express on Wednesday, Mr Bentil said although corruption fights back, he hopes that “he will not be deterred by the resistance.”

This comes after Labianca Company Limited threatened to take legal action against the Office of the Special Prosecutor (OSP) for issuing an influence-peddling report against it.

The Company said it has not been involved in any corruption-related activities. 

In a statement issued on Wednesday, August 24, it said it has always acted in accordance with due process when applying for customs advance rulings.

In response, Mr Bentil stated that, “everybody has the right to legal redress so whatever is happening in the fighting back is to be expected.

“And already the kinds of problem we are seeing him coming up against are to be expected.”

Mr Bentil said the Special Prosecutor has the wherewithal and legal knowledge in the fight against corruption, adding that “I hope he gets the needed resources to continue this fight.”

“It is not one of those things that you hit and you go, so I am very hopeful and whatever we need to support him we will,” he said.

Speaking on news analysis show Newsfile on Saturday, he condemned such acts saying that there are rules for Parliament that clearly state that being a Parliamentarian is a full-time job.

“Indeed the rule is that if you are an MP, it is a full-time job and if you want to do anything on the side, you need to get the permit from the Speaker so to do,” he added.

He reiterated that more than half of MPs work outside of Parliament for private gain, adding that it is wrong for MPs to treat a full-time job as part-time.

According to Kofi Bentil, Parliamentarians can relinquish their seat if they cannot go to Parliament.

“If you don’t want to do the job of a lawmaker i.e. go and make laws, sit in Parliament to debate, then please don’t go to Parliament,” he pleaded with the MPs.

This comes after the Speaker of Parliament, Alban Bagbin, referred three Members of the House to the Privileges Committee, for their continuous absence in Parliament.

The three are; the Dome-Kwabenya MP, Sarah Adwoa Safo, Ayawaso Central MP, Henry Quartey and Assin Central MP, Kennedy Agyapong. All from the New Patriotic Party (NPP) side of the House.

According to the Speaker, the three legislators have breached the 15-day absence rule, hence his decision to refer them to the Privileges Committee for the necessary actions to be taken.

Delivering his ruling on the floor of Parliament on Tuesday, Mr Alban Bagbin explained that based on the relevant provisions of the 1992 Constitution and the Standing Orders of Parliament, the named NPP lawmakers are guilty of the absenteeism threshold for Members of Parliament.

“I have accordingly come to the irresistible conclusion that a Member who absents himself or herself from 16 sitting days of Parliament in a particular meeting, without the permission in writing of the Speaker, falls squarely within the ambit of Article 97, clause 1(c) of the 1992 Constitution and Order 16(1) of the Standing Orders of Parliament”, he stated.

Reacting to this, Kofi Bentil said that it is good that it is taking place.

This, he claims, will make Parliamentarians sit up and take their jobs seriously, knowing that there will be repercussions if they do not.

He said that the issue of absenteeism in Parliament should be talked about and dealt with because the “Parliamentarians in the Fourth Republic have elevated a footnote into to a keynote.”

He added that to say that he hopes the issue of absenteeism will be taken up by citizens as well and not legislators alone.

“I think the ruling must be enforced so that Parliamentarians will feel the need to do what they have been paid to do and what they stood for election to do,” he stated.

He claimed that some individuals are making attempts to ensure her removal from office to score their political goals.

Speaker of Parliament, Alban Bagbin, on Tuesday, April 5 referred three members of the House to the Privileges Committee for their continuous absence in Parliament.

According to the Speaker, the three legislators have breached the 15-day absence rule, hence his decision to refer them to the Privileges Committee for the necessary actions to be taken.

But in an interview on JoyNews’ Newsfile, Saturday, Mr Bentil says there is an element of witch-hunting in the recent developments which have brought about several debates and disagreements, even among the MPs.

He, however, stated the issue of MPs absenting themselves from duty is becoming endemic and must urgently be addressed.

“Adwoa Safo was the target of a political witch hunt. She was the target of certain people to achieve certain very narrow political goals. But we need to go back a bit; before the last election, I was one of the lawyers working with Odekro, and we had gone to court on this same issue.

“The issue was that there were too many parliamentarians who take monthly salaries, take allowances, and they don’t go to work.

“Out of the 275 parliamentarians that we have, it is our reckoning that less than half of them go to work regularly – less than 50% go to work regularly, and less than 50% contribute to the parliamentary discourse, debates, lawmaking, et cetera.

“We think that is a high cost on this country; we need to do something about it. Some of us believe that we have too many parliamentarians; we are not getting values from them,” he said.

Kofi Bentil called on stakeholders “to find a way in this republic to make sure that we get as much as we can out of our parliamentarians.”

“So, way back then, some of us took the step [but] that case was never called until the election was over. My issue is this; we need to find a way to make our Parliament effective.”

Speaking to Samson Lardy Anyenini on Newsfile, Saturday, he said the levy has been introduced due to government’s realisation of more liquidity in the telecommunications sector, hence the ‘lazy approach’ to collect revenue from Ghanaians.

According to him, the country has a systematic tax collection problem stressing that a better readjustment of the collection system will yield more revenue.

“The E-levy is the lazy man’s approach. It is no hanging fruit. It is easy money. They see a lot of liquidity in the telcos sector, and they believe that we should just reach in and take some of it.

“We are quite sure that a better readjustment of our will yield far more money, especially a focus on the extractive sector, we are quite sure that a better exemption policy will yield far more money.

“However, another thing we are sure about is that E-levy will not give us the kind of money we are looking for,” he said.

He added that “this is not about widening the tax net, it is about just collecting money”.

The private legal practitioner said the levy, if passed, would take a toll on the telecommunication sector by reducing their profits.

He further demanded a review of the country’s tax system to ensure enough revenue generation such that government would avoid lazy means of collecting taxes.

“We need to take a better look at our tax system. The problem is that the same elites who are in charge of the tax system and structures are connected to these mines and companies, so it is difficult for them to do what they need to do to improve our tax outcomes…we need to do some hard modelling in taxation instead of doing these easy cheap things which cannot last more than two years,” he stated.

Mr Kofi Bentil believes the E-levy must be abandoned entirely, and government reduces its expenditure to make up for the shortfall in revenue.

“If we are looking for money to tie us over the next year or two, there are a number of things that we can talk about right now. You have 110 ministers; you can cut it down to 50; nothing will change in this country…you absolutely can stop expensive presidential travel; there are many things that can be stopped,” he said.

Meanwhile, Nyhiaeso MP, Stephen Amoah, has called on opposers of the levy to present data to prove that Ghanaians are against the levy.

The Legislature believes the supposed resistance against the bill is not based on a critical analysis of the needs of the ordinary Ghanaian.

“The NDC, I understand them because they want to come to power. But the so-called experts should provide relevant needed pieces of information out of well-collected research data points so that we can support them,” Dr Amoah said.

His advice comes after the MP for Ablekuma West sat on the laps of Mr Akandoh on Thursday, January 7, 2021 without his consent.

According to Mr Bentil, sitting on someone’s lap without their consent is an assault hence his advice.

He gave the advice on his Facebook page while commenting on the incident, saying Mr Akandoh will win the case if he should sue.

The incident took place amid confusion in Parliament’s Chamber during the early hours of the dissolution of the 7th Parliament of the Republic of Ghana.
