The High Court in Accra has adjourned the GH₵10 million defamation case initiated by former National Security Minister Albert Kan Dapaah against Oliver Barker-Vormawor to February 28, 2025.

Bright Otchere Adjekum, counsel for Kan Dapaah, attempted to seek costs against the defendant on Monday, January 27, 2025, after being shown a letter from Dr. Justice Srem Sai, counsel for Oliver Barker-Vormawor, requesting an adjournment due to his unavailability.

Otchere Adjekum admitted that he had been informed of the letter but had yet to see it. After being shown a copy by the court, he described the letter as a “lame excuse.”

He argued that the grounds for adjournment were not valid, citing ill health or appearing before the Court of Appeal or Supreme Court as proper grounds. He prayed the court to discharge his client, who was scheduled to face further cross-examination from the defense, and award costs against the defendant.

However, the court, presided over by Justice Rev. Fr. Joseph Adu-Owusu Agyeman, did not entertain the request and instead adjourned the case.

Mr. Barker-Vormawor, who was initially absent when the case was called, arrived later. The court urged him to ensure his lawyer was present at the next hearing.

The case centers on a defamation suit filed by Kan Dapaah against Barker-Vormawor, seeking damages of GH₵10 million.


NSC Briefs

On November 20 last year, Albert Kan Dapaah opened his case. Moments after his lawyers, led by Otchere Adjekum, led him to give his testimony, his cross-examination started.

Under cross-examination from Dr. Justice Srem Sai, the National Security Minister told the High Court in Accra that activities of the #FixTheCountry Movement and Oliver Barker-Vormawor featured in “a few of his briefs” at the National Security Council meetings.

According to him, though “my briefs are given orally, there have been a few occasions where it has featured in my (written) briefs.”

Albert Kan Dapaah made this known while facing cross-examination from lawyers of Oliver Barker-Vormawor, led by Dr. Justice Srem Sai, in a case where the minister is demanding a GH₵10 million defamation sum.

The National Security Minister is seeking GH₵10 million from Barker-Vormawor for an alleged bribery allegation made against him.


Background

The National Security Minister has accused the former FixTheCountry Movement convener of defamation and has initiated legal action against him.

Albert Kan Dapaah’s defamation suit was initiated over comments said to have been made by Barker-Vormawor, which the minister alleged defamed him.

The action by Kan Dapaah comes on the back of allegations made by the Fix-The-Country convener that the National Security and some government officials had met him and offered him money to stop his activism against the government.

The allegation was refuted by the National Security Minister, who subsequently filed a defamation suit in court against Barker-Vormawor.

The minister is seeking “recovery of the sum of GH₵10 million as General Damages, including Aggravated and/or Exemplary Damages for Defamation for the words uttered by the Defendant.” He is also seeking “an apology for and retraction of the words complained of” and “a perpetual injunction restraining the Defendant from repeating similar or other defamatory words against the Plaintiff.”

Delegation to Mali

Mr Kan-Dapaah made the statements in the Malian capital, Bamako, when he led senior officials of Ghana’s security and intelligence agencies into strategic discussions with their Malian counterparts in a major step towards enhancing regional security cooperation.

The Ghanaian delegation included the Chief of Army Staff, Major General Bismarck Kwasi Onwona, and other senior military officers.

Mali’s team was led by that country’s Minister of National Security and Civil Protection, General Aly Mohammedine, with other senior security officials of the Malian government in attendance at last Friday’s high-level meeting.

The meeting followed similar engagements with Burkina Faso, Cote d’Ivoire and Togo as Ghana sought to champion collaborative efforts against terrorism and insecurity in the West African sub-region.

Mr Kan-Dapaah pointed out that Mali’s extensive experience in counterterrorism operations made the country a crucial partner for any effective regional response.

“Without Mali’s cooperation, combating terrorism within West Africa would be nearly impossible,” he said.

Acknowledging the high stakes, he warned that without prompt and coordinated action, the terrorist threat could become unmanageable within two years, threatening the stability and safety of the entire sub-region.

Regional challenges

The meeting also reflected on broader regional challenges to security cooperation, particularly in the light of recent developments within West Africa.

The establishment of the Alliance of Sahel States and the exit of its member states from the Economic Community of West African States (ECOWAS) signalled growing tensions in the sub-region and posed significant challenges to security partnerships.

In response, Mr Kan-Dapaah called for renewed bilateral agreements rooted in trust and cooperation, and proposed a re-evaluation of relationships within the sub-region to ensure effective collaboration.

Mali’s Gen. Mohammedine praised Mr Kan-Dapaah for his extensive experience and objective approach to addressing regional security.

He insisted that security remained a foundational development pillar, and reiterated Mali’s commitment to tackling terrorism as a borderless threat, underscoring the importance of solidarity among African nations.

Gen. Mohammedine expressed optimism that public support for security initiatives could strengthen the influence of Mali’s army and enhance collaborative security efforts with regional allies, including Ghana.

Regional front

The Ghana-Mali security collaboration discussions are part of Ghana’s ongoing efforts to consolidate a regional front against terrorism, a mission Ghana has led since 2017 with the establishment of the Accra Initiative.

By spearheading this initiative, Ghana has persistently promoted cooperative security solutions, bringing together West African nations to address transnational threats.

Amid recent political tensions and realignments within ECOWAS, Ghana continues to demonstrate its commitment to regional stability and solidarity, positioning itself as a critical partner in tackling terrorism and fortifying West African security.

This latest engagement with Mali reaffirms Ghana’s enduring leadership role and the nation’s readiness to support its neighbours, a move that advances collaborative efforts to safeguard the stability and resilience of the West African sub-region.

“The Committee urges the public to dismiss these allegations as they are entirely unfounded. No such demand or payment has occurred,” the statement asserted.

The committee clarified that their engagement with Organised Labour was conducted in good faith and without any inducements.

“The discussions were held honestly and without any ulterior motives,” he emphasized.

The Adhoc Ministerial Committee, which is dedicated to addressing illegal and irresponsible mining, reaffirmed its commitment to collaborating with all relevant stakeholders.

“We urge the public to ignore these false claims,” the statement concluded.

The Minister stressed the importance of establishing a robust and transparent electoral system that would ensure all parties accept the results.

“Indeed I have heard some senior people in the political space saying that, that they have lost faith in the courts’ ability to address their concerns when it comes to elections. So this can create a situation that can set the stage for chaos.”

“And it underscores the need for us to build a robust and transparent electoral system where results coming from same will be acceptable by all parties.

“Ghanaians must also be aware of their responsibilities. They must not allow themselves to be used by politicians who lose elections. Peace is very expensive and sometimes we have to make sacrifices one time or the other to maintain it. So may nobody participate in violence. So those who lose, accept it peacefully,” he stated.

He cited previous instances where electoral violence had almost torn the nation apart, underscoring the importance of vigilance and preventive measures.

“Internally and coming home to Ghana, we continue to be confronted with the threat of electoral violence which has in the past threatened to destroy our country,” he stated.

He emphasised the importance of not underestimating this threat, warning that it could compromise the integrity of our democracy, even though Ghana has traditionally been proud of its peaceful transfers of power between the two main political parties.

Kan Dapaah credited the country’s commitment to democratic principles and the role of the judiciary in resolving electoral disputes.

“Yes, we have succeeded as a country in ensuring a transition of power from one political party to another on modernisation,” he said.

Ahead of the 2024 General Elections, the minister expressed concern over the heightened stakes and the fervent aspirations of the two major political parties.

According to him, such ambitious comments from the two major political parties have the potential to incite violence on Election Day if one party loses. This, he added, is a test of our democracy to uphold the peace Ghana enjoys.

“The 2024 general elections will certainly test the strength of our democracy. Given the high stakes involved, where the two major political parties appear convinced about their prospects of emerging victorious. That obviously creates a security challenge for me where I sit.”

Barker Vormawor drags Kan Dapaah to Supreme Court http://34.58.148.58/barker-vormawor-drags-kan-dapaah-to-supreme-court/ Mon, 06 May 2024 13:12:03 +0000 https://www.adomonline.com/?p=2390530 Lawyers of political activist, Oliver Barker-Vormawor, led by Dr Justice Srem-Sai have dragged the National Security Minister, Albert Kan Dapaah to the Supreme Court for refusing to answer some 17 questions in his GH¢10 million defamation case.

The action to the apex Court is to order the Minister to respond to those questions of facts which in his view would put clarity on the suit against him at the High Court.

The decision to go to the Supreme Court was premised on the Minister’s response that, it bothers on national security.

On February 28, 2024, a response filed by lawyers of the Minister led by Bright Otchere Adjekum titled “Response to request to admit facts” said the Minister refuses to respond to the questions because of national security reasons.

They also said request for their client to admits to those facts bothers on National security confidentiality and his Oath of Secrecy as a Minister.

Dissatisfied with the Minister’s refusal to respond to the questions of facts, Barker-Vormawor and his lawyers led by Dr Justice Srem-Sai have filed a “Motion on notice for an order for disclosure of facts or documents pursuant to article 135 of the 1992 Constitution,” at the apex Court.

“Take notice that this honourable Court shall be moved by DR JUSTICE SREM-SAI, ESQ., of PRAETORIUM SOLICITORS, Counsel for and on behalf of the Defendant/Applicant herein, praying the honourable Court to, on the ground set forth in the accompanying affidavit:

“Order the Plaintiff/Respondent to disclose the official facts or documents in answer to the Defendant/Applicant’s Request to Admit Facts dated February 13, 2024, to the Court for consideration, and;

“Make any other order (s) which the honourable Court deems fit,” the motion paper stated.

Affidavit in support

In his affidavit in support of the motion, Barker-Vormawor contended that, his request for the minister to admit to facts, if answered would reveal that, the Minister tried to dissuade him from continuing with his civic activism.

a. That the Plaintiff was directed by the government to, on its behalf, dissuade or prevent me from continuing with my civic activism with the FixTheCountry movement,

b. That the government, through the Plaintiff, did, with pecuniary and other offers, attempt to procure me to abandon my civic activism with the FixTheCountry movement,

c. That the Plaintiff did cause, conspire to cause or was complicit in causing my arrest, detention, torture, threats of harm and death, abuse, harassment, and, also, complicit in the prosecutions which I have been going through since February 2021, and

d. That the government’s decision – to declare me a national security threat, and cause my surveillance, arrest, detention, torture, inhumane treatments, and trial on charges of treason and traffic offences – was actuated by my refusal to abandon my civil activism with the FixTheCountry movement.

A date is yet to be fixed for the motion filed on April 30, 2024, to be heard by the apex Court.

Kan Dapaah’s reply

The National Security Minister Albert Kan Dapaah while refusing to admit to those questions cited national security reasons.

In a response filed by lawyers of the Minister on February 28, 2024, led by Bright Otchere Adjekum titled “Response to request to admit facts” said the Minister refuses to respond to the questions.

“Take notice that the Plaintiff (Kan Dapaah) refuses to admit the several facts contained in Paragraphs 3 to 17 of the Request to Admit Facts on the basis of National Security

Confidentiality and his Oath of Secrecy,” Kan Dapaah’s response indicated.

Mr. Kan-Dapaah’s unease comes in the wake of the tragic demise of Lance Corporal Michael Danso during a land ownership conflict in Millennium City, Gomoa East in the Central Region.

According to him, chieftaincy disputes, in particular, presents a persistent challenge to internal security that demands immediate and resolute action.

Speaking at the 2024 Civil Service Week and 2023 Awards ceremony in Accra, the National Security Minister emphasized the need for sustained endeavours to effectively tackle these issues and prevent future incidents.

“Let me say that chieftaincy disputes, in particular, remain a thorny internal security threat that must be permanently dealt with. It is interesting to note that chieftaincy disputes constitute a significant portion of the daily situational reports that are received by my ministry.

“The potential for such chieftaincy disputes to degenerate into violent confrontations compels us to constantly dedicate considerable amounts of resources to the mitigation of such threats. And these are resources that would have been channeled into other productive sectors of the economy,” he said.

The High Court presided over by Justice Rev Joseph Owusu-Adu Agyemang held that the application lacks merit.

The court also awarded a cost of GH₵10k against Oliver Barker-Vormawor after lawyers of Kan Dapaah asked for GH₵20,000.

The ruling of the court followed a submission from lawyers of Barker-Vormawor that, the National Security Minister, Albert Kan Dapaah exaggerated and coloured his application by the use of words like bribe or bribery.

The Defendant argued that, the removal of those words from Kan Dapaah’s Statement of Claims means there was no case for defamation to claim.

They contended that a private individual cannot bribe a public officer like Kan Dapaah as per his suit.

But lawyers of the National Security Minister opposed the request and urged the court to dismiss the same with punitive cost.

Over 50 people were hospitalized after some military personnel allegedly unleashed mayhem on the Garu residents over the weekend.

It is alleged that the military attack was in retaliation for an attack on some National Security operatives by a vigilante group in Garu.

In response to calls by Members of Parliament for an investigation into the matter, Andrew Amoako Asiamah, the Second Deputy Speaker of Parliament who chaired proceedings at the time the concern was raised in the House directed the National Security Minister to brief the legislators on the situation on November 9, 2023.

“At the moment, what I want to do is to invite the Minister to appear before the entire house, come and brief us. Probably what we are hearing is different from what the Minister has at his sleeves. So let us invite the Minister to appear before the house, he will come and brief the house, and we will take it on from there.

So I am asking that the Minister appear before the house on Thursday the 9th of November 2023 to brief the house concerning issues related to happenings at Garu and Tempane.”

Reports indicate that, some military personnel stormed Garu in a dawn raid and assaulted residents in the process.

The Ghana Armed Forces have justified the attacks, accusing irate youth in the area of initiating an attack on national security operatives, which led to the raid.

The National Security Ministry, in a statement, debunked the reports and explained that it was a joint operation to seize weapons used in the October 24 attack by a vigilante group in Garu.

However, the Member of Parliament (MP) for Zebilla East believes it would be prudent for Mr. Dapaah to appear before Parliament to address the matter.

“We will endeavour to make a statement on the floor of Parliament. We will request that Speaker Alban Bagbin invite the Minister of National Security, Kan Dapaah to come and address the House. We will then appeal to the Speaker to set up a committee to investigate this. We had done this in Wa, when soldiers went on rampage and beat up civilians just because a civilian stole a soldier’s motorbike,” he said.

“We went to Wa to investigate it. When soldiers beat up several people in Ashaiman and they made them lay in water and gutters, we went there to investigate, we went to the area and conducted investigations,” he added.

The Association has said it takes serious exceptions to the comments as it has the tendency to gag dissenting opinions on what the government does with the fiduciary trust reposed in it, by the people.

These were contained in a joint statement signed by the President, Prof. Ransford E.V. Gyampo, and the Secretary, Dr. Jerry Joe Harrison which noted the Association does not support any individual or groups calling for a coup in Ghana.

“But at the same time, we won’t be gagged from speaking our minds forcefully on all important national issues. We would fiercely resist any attempt, including political commentary, that has the potency to usher us into the dark days of culture of silence.

The antidotes to coups and military interventions in politics, are good governance, fight against corruption, proper management of the economy and the implementation of proactive pro-poor policies, that can help bridge the gap between the poor and the rich, as well as create a vibrant Middle Class in society,” portions of the statement read.

The Association has further called on the government to secure peace and promote political stability in the country.

Mr. Dapaah blamed these groups of using their influence to create fear and panic in the country.

The Minister feared the development may jeopardize the country’s security ahead of the 2024 general elections.

Reacting to this on Adom FM’s morning show, Dwaso Nsem show Friday, the MFWA boss said Mr. Dapaah’s statement is contrary to the reality on the ground.

“I don’t think people have been making statements to incite coup as the Minister said. Rather people reference the coups that have occurred in some African countries, and advise government to take the necessary steps to avoid such a situation here. I think he did not go through what he read,” he said.

Mr. Braimah advised the National Security Minister to leave the Information Ministry and other government Public Relations outfits to do their job.

He maintained that, Ghanaians have the right to air their frustrations and government on the other hand must address them.

To Mr. Boateng, the National Security Minister’s statement rather incites a coup.

“As a Minister, he should know better this is not the time to talk anyhow. They should ban freedom of speech if they don’t want anyone to talk. But you can’t stop anyone from talking when all is not well. What he is saying is an element of coup itself because he is trying to suppress citizens of a democratic state’s freedom of speech,” he fumed.

The Ghana Boundary Commission in April 2021, begun an audit of the country’s land boundary with Togo to help avert any major land dispute between the two countries. The exercise follows complaints received through the various security agencies, traditional authorities and local authorities concerning some boundary disputes.

The Ghana–Togo Border stretches over a distance of 1,098 kilometres from the tri-point with Burkina Faso in the north to the Atlantic Ocean in the south. Significantly, while the land border exercise is taking place, at the same time the two neighbouring countries are engaged in negotiations regarding the delimitation of their shared maritime border.

Speaking at the closing ceremony of the 7th meeting of the joint technical committee set-up to find a peaceful solution to the maritime boundary between Ghana and Togo, at the Labadi Beach Hotel on Friday, the 25th of June 2021, Mr Kan-Dapaah said beyond the amicable resolution of the maritime boundary dispute between Ghana and Togo, there is the need to urgently address land boundary disputes afflicting the two neighbours.

“While the focus over the past three days (23rd – 25th June 2021) has been primarily on our maritime boundary, it is worth highlighting that Ghana and Togo continue to cooperate on various issues, specifically relating to land boundary issues. Efforts will thus be made to continue to collaborate with Togo on all land issues so that they can be resolved amicably as well,” he said.

“I wish to recommend the establishment of a Joint Technical Committee for Land Boundary between our two countries. The Joint Committee shall jointly resolve all land boundary issues amicably for the peaceful co-existence of the two countries. I wish to task the Ghana Boundary Commission to initiate this idea,” the National Security Minister added.

Delimitation Deadline

On the ongoing negotiation between Ghana and Togo over their maritime boundary, Mr Kan-Dapaah expressed satisfaction with the level of work done by the two sides. He added that he is confident the November 2021 targeted date for the signing of the Ghana/Togo Maritime Boundary Delimitation Agreement will be met.

“At this rate, the Government and People of Ghana are quite optimistic and eagerly looking forward to meeting the November 2021 timeline for the signing of the Ghana/Togo Maritime Boundary Delimitation Agreement, by which time all grey areas would have definitely been clarified. This will thus pave way for another epoch-bilateral summit between our two countries,” Mr Kan-Dapaah said.

The Negotiation

The Seventh Joint Ghana-Togo Technical Committee meeting was aimed at further deliberations on the technical parameters and most importantly, to determine technical arrangements pending the delimitation of the maritime boundaries.

The successful determination of a common delimitated maritime boundary between the two countries will pave the way for the signing of the final Ghana-Togo Maritime Boundary Delimitation Agreement.

The bilateral meeting had the National Commission of Maritime Boundaries of the Republic of Togo representing the Togolese side and the Maritime Technical Committee of the Ghana Boundary Commission representing the Ghana side.

This comes on the back of an alleged assault on Citi FM journalist, Caleb Kudah on Tuesday, May 11, 2021.

The withdrawal was announced in a statement signed by the National Security Minister, Albert Kan Dapaah.

The statement noted the action was taken after its investigative committee established that the arrest and subsequent assault of Citi FM’s Caleb Kudah by Lt Col Agyeman and the others violated the Ministry’s operating standards.

The officer has since been directed to report to the Chief of Defence for further investigations and appropriate action.

“Anywhere you have seen soldiers having to protect a particular individual, it is because, in our assessment of security experts, there is the need for such support to be given to that particular person,” he said while answering a question from Minority Caucus Leader Haruna Iddrisu.

Mr Dapaah stated that the decision to rely on soldiers instead of police is based on intelligence and expert assessments.

“This is a decision normally taken by the security agencies. For instance, when we have a report that a particular individual has a problem and people are after his life, and we think there is a danger, we come in to provide support,” he added.

This comes after people raised issues about the military protection for Electoral Commission Chairperson, Mrs Jean Mensa.

She is always escorted by armed military men at the Supreme Court during hearing of the ongoing presidential election petition.

Many, including IMANI Africa’s vice president, Kofi Bentil, raised issues and wondered if the police are incapable of providing her with security.

But Mr Dapaah explained that such a security support was not limited to ministers and other high profile members of society.

“I do know of a journalist that we continue to provide security cover and security support to,” Mr Dapaah added.

When asked why police could not be relied on to offer such security support, the nominee said it was a question of resources.

“Clearly, the Ghana Police Service and the other security agencies; in terms of equipment, in terms of men, they have never had the full complement of what it takes to provide the most effective policing,” he said.

The National Security Minister-designate, Kan Dapaah, has disclosed that a Commander ordered the military into the Parliamentary Chamber on the eve of swearing-in of the 8th Parliament.

He told Parliament’s Appointments Committee during his vetting that the commander had said things were getting out of hand in the Chamber between the two sides of the House.

“When I saw it I was also alarmed…I posed the question do you think your presence there was going to frighten the Members of Parliament (MPs)? Were you going to arrest them? No, you couldn’t have arrested anybody there,” he said.

However, he said the Chief of Defence Staff (CDS) has been instructed to investigate the military invasion of Parliament during its 8th inauguration.

“I know that orders have been given to the CDS to investigate the military invasion of Parliament and to take the appropriate action,” he said.

Armed military persons invaded the parliamentary chamber on the dawn of January 7 during the election of a new Speaker to ensure order.

This was after National Democratic Congress MPs, led by Chief Whip, Muntaka Mubarak, stalled the process over disagreement about secret ballot.

The presence of the military worsened the situation and they were later recalled. The MPs then demanded an investigation be conducted.

Based on this backdrop, Mr Dapaah said Chief of Defence Staff is leading the probe to take action “if they also come to the conclusion that what was done was totally unprofessional.”

Mr Dapaah assured the Committee that there will not be a repeat of such actions in future.

“If we all do this, we can be assured of a free, fair election,” he said.

Addressing Parliament on the state of security in the country ahead of the December elections, Mr Dapaah said the country is safe based on available crime statistics.

On December elections, the Minister said the national elections taskforce has put in place adequate measures to ensure violent-free elections.

He also urged political parties to uphold peace and unity ahead during and after the elections to protect the country’s democracy.

The Minister said the government has installed a total of 800 high technology security cameras within the Greater Accra region under the phase one and additional national 10,000 cameras will be installed across the country under phase two.

On the disturbances by secessionist groups in the Volta Region, Mr Dapaah also fought off claims that the government has incompetently handled the disturbances.

The Minister said he disagrees with the assertion that the activities of Western Togoland is as a result of incompetence or intelligence failure.

He also urged the public to volunteer information to the security agencies to act promptly.

On activities of terrorism, Mr Dapaah said Ghana stands prepared to combat such activities in the country.

But the Minority Leader, Haruna Iddrisu, on his part, hit back at the Minister, insisting that there’s some sense of insecurity in the country.

He said the opposition National Democratic Congress will not accept any form of intimidation by the security agencies.

This, the Majority Leader explained, is to help the legislature assess the readiness of the country as the December 7 polls draw near.

National Security Minister Albert Kan Dapaah, has been asked to resign honourably following the leakage of a video conversation between him and his alleged lover that that has gone viral on social media.

Chief Executive of the African Centre for Security Studies, Paul Boateng, says the embattled minister was not security conscious enough if the content of the video that is in the public domain are genuine.

“I won’t judge the security minister on moral grounds because no one is perfect but my comment is based on security implications [of his action] as a security expert. If the video that has gone viral involving the minister is indeed true, then I am highly disappointed in him, looking at how sensitive his position is,” he said.

Mr. Boateng, therefore, believes resignation will be an honourable thing and the best option since he failed to protect his office.

“He should just resign or the President should sack him,” he demanded.

Mr. Boateng was speaking on Adom FM’s morning show Dwaso Nsem, Monday.

Mr Boateng also explained that inasmuch as his conduct in the said video posed security threat to his person, it also had the propensity to deter investors.

“As a head of security, if you are unable to protect your security then you have compromised your position and send a wrong signal which can drive away investors. He has exposed his level of understanding of security issues,” he noted.

Mr Boateng has therefore asked the President to immediately sack Mr Dapaah because his conversation with the lady has exposed him on how he has compromised security and intelligent-related issues.

He also indicated that minister’s action could affect Ghana’s relationship with other countries.

Word of Advice to Top Government Officials

Mr Boateng also added that anybody could be pardoned for being careless but not a person in the position of a National Security Minister.

He urged government officials to be careful with how they interact with people, especially in the election year.

“The ministers and the MPs should be careful; as we approach the election, all these things will happen so they should be extra vigilant and not fall prey to these ladies or anyone,” he advised.

Ghanaians woke up on Sunday to a viral video of the National Security Minister and an unknown woman in a video call where they were intimate with the said lady instructing the minister to show his face among others.

The specific case in question relates to a Land Rover Range Rover vehicle, which the State took custody of for further investigations.

After Ghana Revenue Authority’s (GRA’s) investigations into the matter, however, it requested that the importer, Mr Toku Asiamah, paid some penalty to which he obliged and duly paid.

Following the payment, the Commissioner of the Customs Division of the GRA wrote to the Deputy Coordinator of the National Security Council and ordered that the vehicle be released to Mr Toku.

The letter, which was written by a GRA official, Habib Osman, an Assistant Commissioner, Preventive on behalf of the Commissioner and dated June 28, 2019 said among other things that checks run through the GCMS revealed that the Customs Declaration and other documents presented by the applicant correspond with what was found in the system.

Consequently, Commissioner has therefore authorised the release of the vehicle to the owner Toku Asiamah, the letter directed further.

In spite of the above letter, the vehicle has still not been released despite several attempts by the vehicle owner to have custody of his vehicle.

Facts available suggested that some national security operatives are illegally keeping and using the vehicle with impunity and for their personal errands.
