The case began following Buabeng’s arrest after filing a lawsuit against the Electoral Commission (EC) for allegedly breaching her privacy.

She claimed that her nomination forms, submitted to the EC, were obtained and read verbatim on radio by the incumbent Member of Parliament, Alexander Afenyo-Markin.

Despite a court directive for the police to await her counsel’s production of her, Ms Buabeng was arrested and later granted bail. She was rearrested on November 23, 2024, after police found a voter ID card in her campaign coordinator’s possession, leading to charges of “unlawful possession of documents” and “conspiracy to commit crime.”

Initially charged under the EC Act, prosecution revised the charges under CI 91 after counsel pointed out discrepancies in the legal basis. However, the court, presided over by Her Worship Josephine Abigail Fosuaa Appiah, handed a four-day remand to the accused persons.

Prosecution’s inability to produce the accused in court during subsequent hearings, including during special voting, sparked tension among Buabeng’s supporters.

The court eventually granted bail conditions of GHC50,000 and three sureties, including a police officer of chief inspector rank. This was later revised to GHC50,000 with one surety each by the Cape Coast High Court.

On three separate occasions, the prosecution failed to present evidence, prompting the court to strike out the case on December 10, 2024, for want of prosecution.

Ms Buabeng’s counsel, Jennifred Maurice Adjei, described the prosecution’s repeated delays as a failure to substantiate their charges.

“They had no document to support the offence,” he told 3news.com, adding that the court’s decision to discharge his client was warranted.

The counsel announced plans to file lawsuits against the state for human rights violations, malicious prosecution, false imprisonment, unlawful arrest, and defamation.

He is seeking GHC4 million in compensation and has vowed to pursue legal remedies to vindicate his client’s rights.

An independent parliamentary candidate for the Effutu Constituency, Louisa Buabeng, has been remanded into police custody by the Winneba High Court on Thursday, November 28, 2024.

The ruling, delivered by Her Ladyship Justice Josephine Abigail Ofosu Appiah, followed Ms. Buabeng’s arrest on November 20 at the court premises after a hearing related to an election petition she filed.

She was later re-arrested on the evening of Wednesday, November 27, and brought before the court the following morning.

According to Citi News, the re-arrest stemmed from the discovery of multiple voter identification cards at the residence of one of her aides.

The aide has been charged with unlawful possession of documents, while Ms. Buabeng faces a charge of conspiracy to commit a crime.

The court has ordered her remand for four days, with her next appearance scheduled for Monday, December 1, 2024.

This was after the regional police command filed an Ex-Parte injunction against the march which was scheduled for Tuesday, January 5, 2021.

The restraining order granted by Justice Kwasi Boakye is valid for ten days and was effective from December 31, 2020.

Sympathisers of the party have since been urged to refrain from engaging in activities that may go contrary to the court order.

According to reports, four party executives, the Communications Officer, Deputy Party Treasurer and a parliamentary candidate who lost the primary were suspended and bared from partaking in any NDC event indefinitely.

However, the executives revealed the suspension is unwarranted, considering the fact that they have not breached any party law.

To this effect, a press conference was held by those suspended to register their dissatisfaction and air their grievances to the party’s National Executives.

However, in an interview with Adom News, Nenyi Akraman, one of the suspended executives revealed upon reaching the office, some party executives mobilised “macho men with cutlasses, sticks and other offensive weapons to attack them.”

Meanwhile, some of the angry members have called on the National Executives to come to the aid of Effutu constituency before the party is destroyed.
