Supreme Court suspends Kpandai parliamentary rerun

The Supreme Court has ordered the suspension of the planned parliamentary election rerun in the Kpandai Constituency and directed lawyers for the New Patriotic Party (NPP) parliamentary candidate, Matthew Nyindam, to serve court processes on the National Democratic Congress (NDC) candidate through substituted service.

The order was issued on Tuesday after the apex court heard an application filed by Mr Nyindam, who is challenging the decision of the Tamale High Court that annulled the December 7, 2024, parliamentary election in the constituency.

The court has adjourned the case to January 13, 2026, for further hearing.

Mr Nyindam, the disputed Member of Parliament, is asking the Supreme Court to review and quash the High Court’s judgment, arguing that the court wrongly assumed jurisdiction in the election petition.

He maintains that the petition, filed by the NDC parliamentary candidate, Daniel Nsala Wakpal, was invalid from the outset and that all proceedings arising from it should be set aside.

According to Mr Nyindam, the High Court acted outside its legal mandate and committed fundamental errors, making judicial intervention by the Supreme Court necessary.

Following the High Court’s ruling, the NPP filed an application for a stay of execution to restrain the Electoral Commission and the NDC from taking steps to enforce the judgment, including conducting a rerun of the election.
